Box 3222 Anaheim, California 92803, owner, and GFELLER DEVELOPMENT COMPANY, INC. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 17, 1983 at 1:30 p.m,, notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts; 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Sections 18.06.080 & 18.32.050.080 to wit: to permit a 47-space temporary relocation mobilehome park with waivers of the following: (a) SECTION 18,0~.043.101 - Maximum wall heiaht and 18.32.064 (b) SECTION 18.06.050.014 - Minimum number and t e of arkin and 18.32.066.010 s aces 2. That the proposed waivers (a) and (b) are unnecessary because the proposed use is denied and, furthermore, that revised plans were submitted '~ eliminating the need for said waivers. 4. That the proposed use will adversely affect the adjoining land uses and the growth and devel.opment of the area in which it is proposed to be located. 5. That the si2e and shape o£ the site proposed for the use is not adequate to allow the full development of ~he pr.oposed use in a manner not de~rimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That the granting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7. That the traffic generated by the proposed use will impose an undue burden upon the streets and highways 8esigned and improved to carry the traffic in the area. 8. That 26 persons indicated their presence at said public hearing in opposition and 50 persons indicated their presence at said public hearing in favor; and that no correspondence was received either in opposition to or in favor of the subject petition. ENVIRQNMENTAL IMPACT FINDING: That the Anaheim City Planning Commission does hereby deny certification of Environmental Impact Report No. 259 on the basis that sufficient soils tests were not conducted to accurately determine the depth of the underlying dump site and the type of materials which were used to fil.l said dump. Planning Commission also determined that until such additional data is available, a change in the land use designation should not be made. NOW, THEREFORE, BE IT R~SOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional IIse Permit, on the basis of the aforementioned find.ings.
