PC83-197 A RESOLUTION OF THE ANAHLIM CITY PLANNING COMMISSION THAT PETITION rOR CONDZTIONAL USE PERMIT NO. 2501 BE GRANTED ~3EREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from SHAO HSANG LIU, ET AL., 9710 Hoover Street, Los Angeles, California 90044, owners of certain real property situated in the City of Anaheim, County of Orange, State of Calif.ornia, described as: THE SOUTH 94.00 FEET OF THE NORTH 329.52 FEET OF THE WEST 464.20 FEET~ MEASURED ALONG THE SOUTH LINE OF THE SOU44I HALF OF THE SOUTHWEST QUARTER OF TFiE SOUTHWEST QUARTER OF SECTION 13~ TOWNSHI° 4 SOUTH~ RANGE 11 WEST, IN THE RANCHO LOS COYOTES~ TN THE CITY OF ANAHEIM, COUNTY OF ORANGE~ STATE OF CALIFORNIA~ AS PER MAP RECORDED IN BOOK 51~ PAGE 11 OF MISCELLANEOUS MAPS~ IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. WHEREAS, tne City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 17, 1983, at 1:30 p,m „ notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.050.160 to wit: to expand an existing motel to 65 units. 2. That the proposed use will not adversely affect the adjoininq land uses and the growth and development of the area in which it is proposed to be located. #0068r PC83-197 '.:i' 3. That the size and shape of the site adequate to allow the full develo menr P~oposed for the use is detrimental to the particular area nor fto hther~p~sed use in a manner not general welfare of the Citizens of the City of nnaheim ce, health, safety and 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and hi9hways designed and improved to carry the traffic in the area. . ,i 3;•' 6. PPosition to the s. , ~ ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the pcoposal to expand an existing motel on an irregulazly-shaped parcel of land consisting of a having a frontage of approximately 94 feer on ther~easately 1.1 acres, Boulevard, and further desc;-ibed as 916 South Beach Boulevard (RUSticfMotel)h and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during ,:`; the public review p-ocess and further finding on the basis of the initial ;; study and any comments received that there is no substantial evidence that the pcoject will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: I• T6at a 6-foot high masonry block wall shall be constructed along the ncrtherly, easterly and southerly property lines. 2• That subject property shall be developerl substantially in accordance with plaae and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4; pcovided, however, that kitchen efficiency units may be installed in no more than twenty-five percent (258) of the mocel units, with a maximum of 6-cubic foot refrigerators, two-burner stoves excluding oven and baking facilities, and single compartment sinks, except that the manager's unit will be allowed to have full kitchen facilities. 3• That prior to final building and zoning inspections, Condition Nos. 1~nd 2, above-mentioned, shall be complied with. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set focth.
