PC83-213 A RESOLUTIUN OF THE ANAHEIM CITY PLANNING COMMISSION iHAT PETITION FOR RECLASSIFICATION N0. 83-84-7 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Reclassification from GLORIA H. MILLER, 80 Harbor Ridge Drive, Newport Beach, California 92660 and DOROTHY H, HURLEY, 2'l Cherry Hills, Newport 9each, California 92660, owners, and G. G. P. ASSOCIATES, INC., 24982 Del Monte, Laguna Hills, California 92653, ATTN: BILL PRNE, agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: PARCEL 1: THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 24, TOWNSHIP 4 SOUTH~ RANGE 11 WEST IN TEiE RANCHO LOS COYOTES AS PER MAP RECORDED IN BOOK 51~ PAGE 11 OF MISCELLANEOUS MAPS~ RECORDS OF ORANGE COUNTY~ CALIFORNIA. EXCEPT THE WEST 132 FEET THEREOF. ALSQ EXCEPT TflE SOUTH 328 FEET THEREOF. ALSO EXCEPT THE EAST 262.30 FEET THEREOF. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 17, 1983 at 1:30 p.m., notice of said public hearing having been duly givert as required by law and in acco=dance with the provisions of the Anaheim Municipal Code. Chapter 18.03, to hear and consider evidence £or and against said proposed reclassification and to investigate and make findings and recommendati.ons tn coanectioa therewith; said publia hearing having been continued to the Planning Commission meeting of November 14, 1983; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and tn its behalf, and after due conside~ation of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner. proposes reclassification of subject property from the RS-A-43,000 (Residential, Agricultural) Zone to the RM-1200 (Residential, Multi.ple-Family) 2one. 2. That the Anaheim General Plan designates subject property for medium-density residential and general commercial land uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in clos~ proximity to subject prcpQrty and to the zones and their permitted uses generally established throughout the community. ~0085r PC83-213 '"..k..,.~. . ' . . . .. . .~::{lf.l That the proposed reclassification of subject property requires the iaprovement of abutting streets in accordance with the Circulation Element of the General Plan, due to the anticipat~d increase in traffic which will be generated by the intensification of land use. 6. That one person indicated his presence at said public hearing in opposition; and that one letter was received in opposition to aubject petition. ENVIRONMENTAL IMPACT PINDING: Thar t~e Anaheim City Planning Commission has reviewed the proposal to reclassify subject property from the RS-A-43,000 (Residential, Agricultucal) Zone to the RM-1200 (Residenti3l, Multiple-Family) Zone to permit a 79-unit senior citizens apartment complex on a rectangularly-shaped parcel of land con~isting of approximateJ.y 1.74 acres, heving a frontage of approximateiy 272 feet on the south side of Sall Road, and further described as 2620 West Ball Road; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review proaess and further finding on the basis of the initial Study and any comments received that there is no substantial evidence tiiat the oroject will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Rec:assification and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property from the RS-A-43,000 (Residential/Agricultural) 2one and to incorporate said described property into the RM-1200 (Residential, Multiple-Family) Zone upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1• That c~mple~ion oF these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 2499. Z. That prior to introduction of an ordinance rezoning subject property, the owner of subject property shall execute and record a covenant against the property restricting occupancy oE the units to a maximum of two occupant~ per unit, at least one of which must be at least 55 years of age or older. 3• That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No 1 of Exhibit Nos. 1 through 3; provided, however, that temporary louvered-type screen devices shall be constructed on top of the carports located adjacent to the southwesterly four ("C') units. The screening shall be approximately eighty (80) feet long and shall adequately screen the proposal from the adjacent dwellings and shall be approved by the City's auilding Division. Said screening shall remain on the carports until the adjacent property to the west, currently zoned RS-A-43,000 with u resolution of intent to RM-1200 and developed with a single-family dwelling, is ultimately developed for uses other than single-family residential. 4. That prior to finaJ. building and zoning inspections, Condition tdo. 2, above-mentioned, shall be complied with. -2- PC83-213 5. r-• BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of khis Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and voi.d.
