PC83-218 A RESOLUTION OF THE ANAHEIM CIT~ PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2510 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Ose Permit from NANCY AN~ JACK CULP, JR., 6614 Oceanview, Carlsbad, Califor.nia 92008, owners of certain real pruperty situated in the City of Anaheim, County of Orange, State of California, described as: LOT 15 OF EUCALYPTUS FOREST TRACT~ IN THE CITY OF ANAHEIM~ AS SBOWN ON A MAP THEREOF RECORDED IN BOOK 5~ PAGES 29 AND 30~ MISCELLANEOUS MAPS~ RECORDS OF SAID ORANGE COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 14, 1983, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Cha~ter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itsel£ and in its behalf, and after due consideration of all evidence and reports oEfered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Sections 18.61.050.502, 18.61.050.507 & 18.61.050.516 to wit: to expand an existing coni:ractor's storage yard. 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full develo_~ment of the proposed use in a manner not detrimental to the particular area nor tc the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 4. That the grar~ting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 6. That no one indicated their presence at said public hearing in opposition; and that ne correspondence was received in opposicion to the subject peti.tion. ~0089r PC83-218 ~ ,p ... . .... . . . . . . . ,~~'+ s (' .'~, ENVIRONMENTF,L IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to expand an existing contractor's storage yard ou a rectangularly-shaped parcel of land consisting of app=oximately 0.86 acre, having a frontage of approximately 132 feet on the south side of Micaloma Avenue and furthec described as 2890 and 2898 Miraloma Avenue; and does hereby approve the Neqative Declaration upon finding that it has considered the Negati.ve Declaration together with any commer.ts received duriny the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby 9rant suk~ject Petition for Conditional Use Permit, upon the following conditions which are hereby £ound to be a necessary pretequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That stceet lighting facilities along Miraloma Avenue shall be installed as required by the Utilities General Manager in accordance with sQecifications on file in the Office of Utilities General Managec, and tnat secut_ity in the form of a bond, certificate of deposit, letter of <:redit, or cash, in an amount and form satisfactory to the Cit;y of Anaheim, shall be posted with the City to guarantee the sati.sfactory completion of the above-mentioned improvements. Said sr::curity shall be posted with the City of Anaheim prior to appro~~al of building permits. The above-required improvements shall be installed prior to commencement of the activity authotized by this resolution. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Aivision. 3. That all outdoor storage areas shall be completely paved with gravel to a minimum depth of (3) inches, and shall permanentiy be so-maintained. 4. That this Conditional Use Perm:t is granted subject to the completion of Reclassification No. 69-70-55, now pending. 5. That subject property shall be developed substantially in accordance with plans and sgecifications on file with the City of Anaheim marked Exhibit No. 1. 6. That prior to the commencement of the activity authorized under this resolution, or prior to the time that a building permit is issued, or within a period of one year from the date of this resolution, whichever occurs fi[st, Condition Nos. 1 and 4, above-mentioned, shall be cumplied with. Extensions fot further time to complete said conditions may be granted in accordance with Section ;8.03.090 of the Anaheim Municipal Code. 7. That prior to final buil~ing and zoning inspections, Condition Nos. 2, 3 and 5, above-mentioned, shall be complied with. _2_ PC83-218 .-~ ~. BE IT FURTHER RESOLVED that the ~naheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unen£orceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
