PC 83-22,~ RESOLUTION NO PC83-22 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR VARIANCE NO. 3319 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Varience from JOHN & ANNE KRAJACIC, P. O. Bo:c 3716, Anaheim, California 92803, owners, of certain real property situated in the City of Anaheim, County of Orange, State of. California described as: THAT PORTION OF LOT S^zVENTEED7 OF THE "ANAHEIM HOMESTEAD T.'2ACT", IN THE CITY OF ANAHEZM~ AS SHOW:~I ON A MAP RECORDEA IN BOOK 26, PAGE 10 pF MISCELLANEOUS RECORDS OF LOS ANGELES COUNTY, CALIFORNIA, DESCRJBED AS FOLLOWS: BEGINNING AT A POINT IN THE CENTER LINE OF NORTH STREET~ DISTANT SOUTH 35° 19' WEST 180.00 PEET FROM THE INTERSECTION OF THE CENTER LINE OF NORTH STREET WITH THE CENTER LINE OP FT~ST STREET AS SHOWN ON SAID MAP; THFNCE SOUTH 85° 19' WEST ALONG THE CENTER LINE OF NORTH aTREET, A DISTANCE OF 85.00 PEET; THENCE SOUTH 170.66 FEET TO THE T70RTH LINE OF L~ND DESCRIBED IN DEED TO R:JTH BROWN, AN UNMARRIED WOMAN, RECORDED MAY 8~ 1952 IN BOOK 2326~ PAGE 519 OF OFFiCIAL RECORDS; THENCE EASTERLY ALONG THE NORTFI LINE OF SAID LAND OF RUTH BROWN, A DISTANCE OF 85.00 FEET; THENCE NORTH 170.66 k~EET TO THE POINT OF BEGINNING. WHEREAS, the City Planning Commission did hold a pub~ic hearing at the City Aall in the City of Anaheim on January 24, 1983, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Coaunission, after due inspection, investigation and study made by i.tself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the £ollowing facts: 1. That the petitioner proPoses waivers of the followinq to establish a 2-lot subdivision: (a) SECTION 18.25.061.O1U - Minimwn lot area (10,000 square feet required; 5,978 and 5,978 square feet proposed) (b) SECTION 18.25.061.020 - Minimum lot width (90 feet required; 85 feet existing) (c) SECTION 18.01.130 - Required lot frontage (Frontage on a public street or alley required; none proposed) 2. Z'hat the above-mentio:~ed waivers are hereby denied on the basis that the petitioner did not demonstratP that a hardship exists. #0445I PC83-22 .--, 3. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinitp and zone. 4. That the requested variance is not r,ecessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the Property 9.n question. 5. That the requested variance will be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in whi.ch the property is located. 6. That 16 persons indicated their presence at said public hearing in opposition; and that a pet=tion containing 45 signatures was received in opposition to subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commisslon has rEViewed the proposal to establish a 2-lot subdivision with waivers of minimum lot area, minimum lot width and required lot frontage on a rectangularly-shaped parcel of. land consisting of approximately 11,956 square feet, havinq a frontage of approximately 85 feet on the south side of North Street, approximately 185 feet west of the centerline oP West Street and further described as 1106 West North Street; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for low-density residential land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that ±he Negative DecZaratioa substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVF;D that the Anaheim City Planning Commission does hereby deny subject Petition for Variance on the basis of the aforementioned findings.
