PC 83-232~. RESOLUTION NO. PC83-232 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION ADOPTING AND RECOI4MENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTION OF AN AMENllMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN DESIGNATED AS AMENDMENT NO. 185 -"EXHIBIT A" WfiEREAS, the City Council of the City of Anaheim did adopt the Anaheim General Plan by Rec:olution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, pursuant to a req~est from a property owner for a General Plan Amendment study, City staff prepared a General Plan Amendment for an area consisting of approximately 5.3 acres, with a frontage of 387 feet on the west side of Haster Street, approximately 265 feet south cf the centerline of Katella Avenue; and WHEREP.S, the Planning Department deemed it appropriate, pursuant to the provisions of the California Environmental Quality Act, to prepare an Environmental Impact Repoct No. 262 in connection with requested conditional use permits, reclassification and General Plan Amendment No. 185; and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on November 28, 1983, at 1:30 p.m., notice of said public hearing havin9 been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear an@ consider evidence for and against said Amendment to the Anuheim General Plan, Land Use Element, and to investigate and make findings and recommendations in connection therewith; and subject petition having been continued to the mee~ing of December 12, 1983; and WHEREAS, said Cummission, after @ue consideration, inspection, i;ivestigation and study made by itself, and after due consideration of all evidence and reports offered at said publ.ic hearing, DOES HEREBY FIND: 1. That two persons indicated their presence in opposition to subject request at the public hearings; and that no correspondence was received in opposition to the subject petition. 2. That evidence was presented which substantiates the need for an amendment to the Anaheim General Plan, and it is deemed appropriate that "Exhibit A• be adopted, designating the entire 5.3 acre study ar.ea for Medittm Density Residential. NOW, THEREFORE, BE IT RESOLVED that after considering Draft EIR No. 262 Por the proposed Riviera Project and reviewing evidence, both written an~ oral, presented to supplement. Draft EIR No. 262, the Planning Commission finds that EIR No, 262 is in compliance with the California Environmental Quality Act and the City and State CEQA Guidelines; and that the Planning Commission further finds that economic and social considerakions make it infeasible to eliminate entirely the si9nificant environmental impacts which have been #0116r PC83-232 , ~', identified in Final EIR No. 262. However, the benefits of the project have been balanced against the unavoidable environmental impact and pucsuant to the provisions of Section 15093 of the State CEQA Guidelines, the occurrence of the significan~ environmental effects identified in Final EIR No. 262 and as set forth above may be permitred without furthec mitigation due to the following overriding considerations: (1) after completion, the proposed project is expected to generate a net fiscal surplus of $1,620,500 per year for the City. This will provide funds for the operation of programs for the benefit of all Anaheim residents which would not otherwise be economically feasible; (2) the proposed project will provide a balanceci development which is compatible with and complementary to the adjacent commercial-recreation area; and (3} the proposed project will provide employment for an esti.mated 4,200 persons; therefore, the Planning Commission hereby certifies EIR No. 262 for the Riviera Pzoject and adopts this Statement of Overriding Considerations. BE iT FURTHER RESOLVED THAT, pursuant to the f~regoing findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 185 - Land Use Element, Exhibit A.
