PC83-235 A RESOLUTION OF THE ANAHEIM CITY PLAP'.NING COMMISSION THAT PCTITION FOR CONDITIONAL US6 PERMIT NO. 2515 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from U-HAUL COMPANY OF ORANGE COUNTY, 860 South Placentia Avenue, Placentia, California 92G70, owner of certain real propecty situated in the City of Anaheim, County of Orange, State of California, described as: LOTS 3, 4~ 5, 6 AND 7, IN BLOCK A, OF TRACT 373, IN THE CITY OF ANAHEIM, AS PER MAP RFCORDED IN BOOK 15 PAGE 49, MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY AND LOTS 1 AND 2 IN BLOCK A OF TRACT NO. 373, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE~ STATE OF CALIFORNIA~ AS SHOWN ON A MAP RECORDED IN BOOK 15, PAGE 49 OF MISCELLANEOUS MAPS~ IN THE OFFICE OF THE RECORDER OF SAID COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on December 12, 1983, at 1:30 p.m., notice of saic3 public hearing having been duly given as required by law and in accordance with the p:ovisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and stuc~y made by itself and in its behalf, and after due consideration of all evidence and reports offeeed at said hearing, does find and determine the following facts: 1. That the proposed use is properly ane for wFich a conditional use permit is authorized by Anaheim Municipai Code Sectian 18.06.OD0 and 18.03.030.010 to wit: to expand a truck and trailer ren~al facility with waiver of the following: SECTIONS 18.06.050.022, - t4inimum number of parkinq space:s 18.06.050.031, (40 spaces required; 14 spaces existing) AND 18.45.066.050 2. That the requested waiver is hereby granteS on the basis that the parking variance will not cause an increase in kraffic congestion in the immediate vicinity not adversely affect any adjoining land uses; and that the granting of the parkin9 variance under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheirn. 3. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be locatad. 4. That the size and shape of Lhe site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welface of the Citizens of the City oE Anaheim. #0106r PC83-235 5. That the granting of the Conditional Use Permit under the con~itions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the Czty of Anaheim. 6. That the traffic generated by the proposed use will not impose an undue burden unon the streets and highways designed and improved to carr.y the traffic in the area. 7. That no one indicated their presence at said public hearing in opposiL-ion; and that no correspondencE was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FZNDING: That the Anaheim City Planning Commission has re•~iewed tiie proposal to expand a truck and trailer rental Eacility with waiver of minimum number of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 0.8 acre located at L-he southeast corner of water Street and Anaheim Boulevard, and further described as 600-626 South Anaheim Boulevard (U-Haul Moving and Storage); and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE :T RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That prior to issuance of a building permit, t;~e appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings. 2. That the owner of subject property shall pay to the City of Anaheim a fee for tree planting purposes for a distance of 104 feet along Anaheim eoule•rard in an amount as determined by the City Council. 3. That the owner oE subject property shall submit a letter requesting termination of Variance Nos. 1975 and 2118 to the Planning Department. 4. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 5. That prior to the commencement of the activity authorized under this resolution, or prior to the time that a building permit is issued, or witnin a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 2 and 3, above-men~ioned, shall be complied with. Extensions for Eurther time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. -2- PC83-235 6. That prior to final building and zoning inspections, Condition No. 4, above-mentiuned, shall be complied with. BE IT EURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution .is expressly predicated upon applicant's compli.ance with each and all of the conditions hereinabo~:e set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court ~f competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
