PC83-247 A RESOLUTION OF THE ANAHEIM CITY PLANNIN~ COMMISSION APPROVING REVISGD PLANS MARKEA (REVISION NO. 1) FOR ^_ONDITIONAL USE PERMIT N0. 2514 WHEREAS, Conditional Use Pecmit No. 2514 (to pecmit a 13-bed expansion to an existing 46-bed facility) caas appro~~ed by the Planning Commission on November 14, 1983, in connection with Resolution No. PC83-221; and WHEREAS, the petitior~ec has subnitted revised plans marked Revision No. 1 proposing to expand the existing convalescent hospital an additional 23 beds £rom a 46-bed facility to a 69-bed facility; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Centec, Council Chamber, 200 S. Anaheim Boulevard, Anaheim, Califocnia on December 28, 1983, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the pzovisions of the Anaheim Municipal Code, Chapter 18.03, to hear and considec evidence for and against Revision No. 1 of the approved plans and ~pecifications for said conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, iavestigation and study made by itself at said public heazing, DOES HEREBY FIND: 1. That the pcoposed use is properly one for which a conditional use pecmit is authorized by Anaheim Municipal Code Section 18.44.050.170 to wit: to permit expansion of an existing convalescent hospital to 69 beds. 2. That the proposed use will not adversely affect the adjoining land uses and the growth und @evelopmen! of the azea in :,hfch ft i~ progoced to be located. 3. That the size and shape of the site pxoposed for the use is adequate to allow the full developm~nt of the pcoposed use in a manner not detrimental to the particular area nor to the peace, health, safety and genecal welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will ~ot be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the tcaffic generated by the proposed use will not impose an undue burden upon tye streets and highways designed and improved to carry the tzaffic in the area. 6. That no one indicated their, presence at said public hearing in opposition; and that no cocrespondence was received in opposition to the subject petition. ~01119z PC83-247 ~^ ,"y'; ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning ;~:~ Commi:sion has ceviewed the propocal to expand an existing convalescent hospital on a rectangulacly-shaped paccel of land consisting of approximately i~ 1.6 aczes, having a frontage of approximately 178 feet on the south side of Ocange Avenue, and further described as 1720 West Oxange Avenue (Ozangeview ^: Convalescent Hospital); and does hereby appcove the Negative Declacation upon ,:, finding that it has considered the Negative Declaration toqether with any ;~ comments received during the public review process and fuctheX finding on the ;, basis of the initial study and any comments ceceived that thece is no su.bstantial evidence that the project will have a,ignificant effect on the `~ enviconment. NOW, THEREFORE, gE IT RESOLVED that the Anaheim City Planning Commission does hereby gcant subject Petition for Conditional Use Permit, upon the followi.ng conditions which are hereby found to be a necessary prerequisite to the proposed use of the subjeet property in ocder to presecve the safety and genecal welfare of the Citizens of the City of Anaheim: 1. That the owner of subject property shall pay to the City of Anaheim a fee for tcee planting purposes along Orange Avenue in an amount as determined by the City Council. 2• That the appropriate traffic signal fee shall be paid to the City of Anaheim in an amount as determined by the City Council for each new comneccial building. 3• That subiect property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 1 of Exhibit Nos. 1 through 3,; pcovided, howevec, that as required by the City Tzaffic Engir~eer the existing d~iveway on Orange Avenue shall be widened to a minimum of 24 feet and that the curb cuts shall be reconstructed with 10 foot radius curb returns. 4• That Condition Nos. 1 and 2, above-mentioned, shall be completed within a period of 90 days from the date of this resolution. 5. That pcior to final building and zonin9 inspections, Condition No. 3, above-mentioned, sha11 be complied with. BE IT FUR~BER RESOLVED that the Anaheim City Planninq Commission does hereby find and detecmine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the condition~ hereinabove se•t focth. Should any such conditions, or any part thereof, be declared invalid or unenf.orceable by the final judgment of any court of competent jucisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. -2 PC83-247 ~f~ ''"`. , .
