PC83-2G A RESOLUTION OF THE ANAHCIM CITY PLANNING COMMISSION THAT P~TITION POR CONDITIONAL USE PERMIT NO. 2373 BE DENIED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit °rom IBERHAM AI,I ATA, 26371 Avery Parkway, Mission Viejo, California 92675 and TALAT RADWAN, 26371 Avery Parkway, Mission Viejo, California 92675 & AL SERRATO, 2901 South Rene Drive, Santa Ana, California 92704, agents of certain real property situated in the City of Anaheim, County of Orange, State af California, described as: THE SOUTH 160 FEET OF THE EAST 115 FEET OF LOT 67 OF TRACT NO. 2773, AS SHOWN ON A MAP RECORDED IN BOOK 115~ PAGES 24~ 25, AND 26 OF MISCELLANEOUS MAPS, RECORDS OP SAID COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 7, 1983 at ::30 p.m., notice of said public hearing having been duly given as required by luw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence £or and against said proposed conditional use p~rmit and to investigate and malce findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigaticn and study made by itself and in its behalf, and after due consideration of all evidence and reports offer.ed at said hearing, does find and determine the following facts: 1• That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Nunicipal Code Section 18.03.030.010 to wit: to permit the addition of a convenience market to an existing gasoline service station. z• That the proposed use is hereby denied on the basis that the size and shape of the site is not adequate to accommodate the dual commercial uses as proposed. 3• That the proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4• That the size and shape of the site proposed for the use is not adequate to allow the ful.l development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5• That the granting of the Conditional Use Permit under the conditions imposed, if any, will be detrimentaZ to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6• That the traffic generated by the proposed use will impose an undue burden upon the streets and hic~hways designed and improved to carry the traffic in the area. #04732 PC83-26 , --, .-~ 7. That 6 persons indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: An EIR Negative Declaration was previously approved by the Planning Commi.ssion on October 4, 1982 and by the City Council on November 2, 1982 in conjunction this Conditional Use Permit No. 2373 when it was previously considered and denied. NOt4, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit, en the basis of the aforementioned findings.
