PC83-27 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION POR CONDITIONAL USE PERMIZ NO. 2405 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from CENTRALIA SCHOOL DISTRICT, G625 La Palma Avenue, Buena Park, California 90620, owner, & DR. DONALD HECHT, 12756 E. Alchester Street, Cerritos, California 90701, agent of certain real property situated in the City of Anahe.im, County of Orange, State of California, described as: TAE SOUTH HALF OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 11, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER NlAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS~ IN THE OFFICE OF THE COUNTY RECORDER OF' S~ID COUNTY. WFiERE~1S, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 7, 1983, at 1:30 p.m., notice of said public hearing having been duly given as requi.red by law and in accordance with i:he provisions of the Anaheim Municipal. Code, Chapter 18.03, to hear and consider. evidence for and against said proposed conditional uae permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Cor,~mission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of a11 evidence and reports o£fered ~t said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use per.mit is authorized by Anaheim Municipal Code Section 18.21.050.120 to wit: to permit a private vocational and business colleqe in an existing public school facility. 2. That the proposed use is hereby granted subject to the petitioner's stipulation to provide a six (6)-foot high block wall and a twenty (20)-foot wide landscaped setback as a buffer between the parking lot and the residential area along the western half of the northern property line, amounting to a distance of approximately 710 feet. 3. That the proposed use, as qranted, will not adversely affect the adjoininy land uses and the growth and development of the area in which it is proposed to be located. 4. That the size and shape o£ the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That the granting of the Conditional Use Permit under the conditions imposed will iiut be detrimental. to ti~e peace, iiealth, safety and general welfare of the Citizens of the City of Anaheim. 6. That the tra£fic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 7. That one person indicated his pr.esence zt said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVTRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commi.ssion has reviewed the proposal to permit a private vocational and business college in an existing public school facility on an irregularly-shaped parcel of land consisting of approximately 12.8 acres, having approximate frontages of 425 feet on the north side of Lincoln Avenue and 150 feet on the west side of Western Avenue and furtlier described as 3301 West Lincoln Avenue (Centralia Elementary School); and does hereby approve ~he Negative Declaration from the requirement to prepare an environmental impact report on tne basis that there wou.ld be no siqnif~cant individual or -2- PC83-27 _~ cumulative adversc environmental impact due to the approval of thi~ Negative Declaration since the Anaheim General Plan designates the subject property for an elementary school site land uses commensurates with the proposal; that no sensitive environmental impacts are involved in the proposal; that th~ Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW, THEREFORE, gE IT REgOLVED that the Anaheim City Planning Conunissic•n does 4ereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and genex•al welfare of the Citizens of the City of Anaheim: 1• That all engineering requirements of the City of Anaheim, along Lincoln Avenue including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other EnPg neeraand W n kaccordancee withPspecif cations on f le inYthe Office of the City Engineer; that street lighting facilities along Lincoln Avenue shall be installed as required by the Office of Utilities General Manager, and in accordance with specifications on file in the Office of the Office of Utilities General Manager; and or that security in the form of a bond, certificate of deposit, etter of credit or cash, in an amount and form satisiactory to the City of Anaheim shall be postec~ with the City to guarantee the satisfactory instaZlation of the above-mentioned improvements. Said security shall be posted with the City prior to approval of improvement plans. The above-required improvements shall be installed prior to commencing the activity authorized by this zoning action. z• That t.rash storage areas shall be provided in accordance with approved plans on file with the Office o£ the Executive Director of Public Warks. 3. That the owner(s) o£ subject property shall pay the traffic siqnal assessment fee (Ordinance No. 3896), in an amount as decermined by the City Council, for commercial buildings. 4• That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim. 5• That subject property shall be developed substantially in accordance with plans and specificationy on file with the City of Anaheim marked Exhibit No. 1; provided, however that a six {6) foot high block wall and a twenty (20)-foot wide landscaped setback shall be provided along the western half of the northerly property line for a distance of approximately 710 feet separating the parking lot and residential uses in the City of Buena Park. -3- t ~ ~ PC83-27 ~ ~ ~ 6• That all proposed vehicular parking areas shall be improved with asphalt paving, wheel stops, and striping to City specifications anfl standards. ~• That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housinq, Mechanical and Pire Codes as adopted by the City of Anaheim. 8- That Conditions No.(s) 1 through 7, abova-mentioned, shall be completed prior to the commencement of the activity authorized by this conditional use permit. HE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
