WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 7, 1983, at 1:30 p.m., notice of said public hearing having been dulp given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings ar.d recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and dPtermine the following facts: 1. That the petitioner proposes waivers of the following to construct a restaurant addition to an existing motel and to permit a roof sig*i: (a) SECTION 18.04.045.012 - Minimum landscaped setback. (20 feet of special setback required along Harbor Hlvd.; 15 feet proposed) (b) SECTION 18.05.093.033 - Permitted locat•ion of roof sign (86 feet from east ~roperty line requixed; 30 feet pro,posed) #0478I PC83-31 (c) SECTION 18.05.093.0331- Minimum distance between signs (300 feet required; 15 £eet proposed) (d) SECTION 18.44.066.050 - Minimum number of parking spaces & 18.06.050.024 (102 spaces required; 45 spaces proposed) 2. That the above-mentioned ~vaivers are hereby denied on the basis that the petitioner did not demonstrate that a hardship exists due to che size, shape, locatian or surroundings of subject property- 3. That the proposed variance is furthermore denied on the basis that the parkinq study provided by the petitioner showed that the proposed parking would not be adequate for the proposed use and that the requested waiver is a substantial deviance from the Code requirement. 4. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 5. That the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity arid zone, and denied to the property in question. 6. That the requested variance will be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 7. That no one indicated their presence at said public hearir.g in opposition; and that no correspondence was received in opposition to subjert petition. EL~VIROtI.~NT~I, ~MPACT FINDING: That the 71n3heim City Planning Commission has reviewed the proposal to construct a restaurant addition to an existing motel and to permit a roof sign with waivers of mir_imum landscaped setback, permitted location of roof sign, minimum distance between signs an3 min~mum number of parking spaces on an irregularly-shaped parcel of land consisting of approximately 1.07 acres, having a frontage of approximately 215 feet on the north side of Katella Avenue, and Eurther described as 631 West Katella (Waikiki Motor Inn); and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumulative adverse envi.ronmental impact due to the approval of this Negative Declaration since the Anaheim General Plar, designates the subject property for coaunercial recreation land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Degative Declaration substantiating the foregoing findings is on file in .he City of Anaheim Planning Department.
