PC83-37 A RESULUTION OF TFIE ANAHEIM CITY PLpNNING COMMISSION ADOPTING AP7D RECOMMENDING TO TIiE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTION OF GENF,RAL PLAN AMENDMENT NO. 181 - L}1ND USE ELEMENT WHEREAS, the City C~uncil of the Ci.ty of Anaheim did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of land uses within the City and indicating the present belief of the Council as to possible future development and redevelogment of land within the City; and WHEREAS, the City Council of the City of Anaheim did adopt the Canyon Area General Plan on Marc:~ 8, 1977 as the official guide for development in the Canyon Area; and WHEREAS, pursuant to a request from the property owner for a General Plan Amendment study, City staff prepared a General Plan Amendment for an area consisting of approximately 4.3 acres fronting on Villa Real Drive, located south of Nohl Ranch Road and immediately north of the Ulive Hi11s Reservoir ar~d the Anaheim/Orange City Limits; and WHEREAS, the Planning Department deemed it appropriate, pursuant to the provisions of tlze California Environmental Quality Act, that there are no signifi- cant environmental impacts and recommended that a Negative Declaration be approved; and 47HEREAS, the Anaheim City Planning Commission did iiold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on February 7, 1983, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said Amendment to the Anaheim General Plan, Land Use Element, and to investigate and mal:e findings and recommendations in connection therewith; and subj~ct petit_ion having been contiiiued to the meeting of February 23, 1963; and WHEREAS, said Commission, after due consideration, inspection, inveszi- gation and study made by itself, and after due consideration of all evidence and reports offered at said public hearing, DOES HEREgy FIND: 1. That no one indicated t}ieir presence in opposition to subject request at the public hearing; and that one letter was received in opposition to subject request. 2. That evidence was presented which substantiates the need for an amendment to the Anaheim General Plan, and it is d_emed appropriate that "Exhibit A" be adopted, designating the study area for Hillside Low-Medium Density Residential. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission has reviewed the proposal to change the current hiliside low density residential and general open space designations to hillside low-medium density residential and to reclassify sLbject property from the R5-A-43,000(SC) (Residential, Agricultural, Scenic Corridor Overlay) Zone to the RM-3000(SC) (Residenti.al, Alultiple-Family, Scenic Corridor Overlay) 2one to construct a 25-unit condominium complex and to remove thrFe (3) sperimen trees on an irregularly-shaped parceZ of lc~iid consisting PC83-37 of approximately 4.32 acres fronting on Villa Real Drive and located south of Nohl Ranch Road and immediately north of the Olive Hills Reservoir and the Anaheim/Orange City Limits; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no signi- ficant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for hillside low-density residential land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Ini.tial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmenta]_ impacts; and that the Negative Declaration substan- tiating the foregoing findings is on file in the City of Ar~aheim Planning Department. BE IT FURTHER RESOLVED THAT, pursuant to the foregoing findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 181 - Land Use Element, Exhibit A.
