WHEREAS, the City Planning Commission 3id hold a public hearing at the Civic Center in the City of Anaheim on February 23, 1483 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions oP the Anaheim Municipal Code. Chapter 18.03, to hear and consider evidence for and against said proposed reclassificatioii and to investigate and make findings and recommendations in connection therewith; and -2- PC83-44 ,'. .,., . , , , , --~ WfiEREAS, said Commission, after c?ue inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject nroperty from the County of Orange A1 (Agricultural, General) Zone to the City of Anaheim CL(SC) (Commercial, Limited - Scenic Corridor Overlay) Zone on Tortion A, and to the City of Anaheim hff,(SC) (Industrial, Limited - Scenic Corridor Overlay) Zones on Portion B. 2• That the Anaheim General Plan designates subject property for general open space and general industrial land uses. General Plan Amendment No. 182, currently pending, proposes a change in the land use designation to General Commercial and/or Commercial Professional and General Industrial. 3. That the requested reclassification of Portion A is hereby granted for the CO(SC) (Commercial, Office - Scenic Corridor Overlay) Zone rather than CL(SC) (Commercial, Limited - Scenic Corridor Overlay) Zone, as requested, on the basis that access to the site and the streets and highways in the area may not be adequate to accommodate the greater amount of traffic generated by general coamiercial uses. The reclassification of Portion B to the 1~II,(SC) (Industrial, Limited - Scenic Corridor Overla~) 2one is granted, as requested. 4. That the proposed reclassi£ication of subject property, as granted, is necessary and/or desirable for the orderly and proper development of the community. 5• That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 6. That no one indicatecl their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT FINDING: That pursuant to the provisions of the California Enviranmental Quality Act, that subject property is covered under Enviromental Impact Report No. 230, previously certified by the City Council on October 16, 1979. NOW, THEREFORE, BE IT RESOLVED that the Flnaheim City Planning Commission does hereby grant subject Petition for Reclassification and, by so doing, that Title 18-2oning of the Anaheim Municipal Code be amended to inaorporate the above-described properties into the CO(SC) (Commercial, nffice - Scenic Corridor Overlay) Zone and the ML(SC) (Industrial, Limited - Scenic Corridor Overlay) Zone upon the following conditions which are hereby found to be a necessary prerequisite to the proposed uss of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That completion of these reclassification proceedings is contingent upon completion of annexation of subject property to the City of Anaheim. -3- PC83-44 2. That prior to commencement of structura]. framing, fire hydrants shall be installed and charged as required and determir..ed to be necessary by the Chief of the Fire Department. 3. That trash starage areas shall be provided in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 4. That prior to issuance of a building permit, the oaner(s) of subject property shall dedicate a 10-foot wide east/west equestrian and hiking trail adjacent to the north property line of subject property. Said trail shall be improved and maintained in accordance with City standards and specifications at the time the property is developed. The owner(s) of subject property shall, additionally, maintain an interim north/south trail through subject property. Said interim tra±l shall be located within an exicting drainage channel traversing subject property. Final alignment of the interim trail shall be subject to review and approval of the Parks, Recreation and Cotnmunity Services Department. 5. That prior to issuance of a building permit, appropriate water assessment fees shall be paid to the City of Anaheim, in an amount as determined by the Office of the Utilities General Manager. 6. That prior to issuance of a building permi.t, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as de~ermined by the City Council for new commercial buildings and new industrial buildings. 7. That subject property shall be served by underground utilities. 8• That the developer of subject property shall provide appropriate electrical conduit and substructure systems through Weir Canyon Road and the bridge over the Santa Ana River to service subject property in accordance with City of Anaheim e2ectrica2 utility specifications. g• That street lights shall be installed along Weir Canyon Road and along all dedicated streets in the proposed development at the time the property develops. 10. That plans shall be submitted to the Building Division showing compliance with the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Aousing, Mechanical and Fire Codes as adopted by the City of Anaheim. The appropriate permits shall be obtained for any necessary work. 11. That subject property shall be developed in conformance with the site development standards of the CO(SC) and ML(SC) Zones. Any deviance from said standards shall be considered in conjunction with a variance request or waiver of code requirement under a conditional use permit application. -4- PC83-44 12. That prior to issuance of building permits or prior to dedication of public street rights-of-way or prior to conNtruction of any streets, whichever occurs first, street names shall be approved by the City Planning Department. 13. That completion of this reclassification procedure is contingent upon approval of General Plan Amendment No. 182 ~hanging the land use designations to General Co~ercial and/or Commercial Professional and General Industrial.
