PC 83-51RESOLUTION NO. PC83-51 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AM~NpING CONDITIOY7 NO. 4 OF PLANNING COMMISSION RESOLUTION NO. PC81-115 GRANTED IN CONNECTION WITH CONDITZONAL USE PERMIT NO. 22G7 WHEREAS, the petitioner submitted a request for an amendment to the conditions of approval contained in Planning Commission Resolution No, PC81-115 adopted in connection with Conditional Use Permit No. 2207, which was granted by the Planning Commission on June 1, 1981, to permit a portable concrete batch plant on property consisting of approximately 3.6 acres, having a frontage of approximately 120 feet on the west side of Richfield Road, and being located approximately 1750 feet south of the centerline of La Palma Avenue; and: WHEREAS, the petitioner requests amendment of Condition No. 4 to allow a maximum of eight (8) trucks with a maximum of six (6) loads per day per truck; and WHEREAS, the petitioner praposes the use to be a portable asphalt plant instead of the portable concrete batch plant originally approved; and WHEREAS, the Anaheim City Planniny Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard on March 7, 1983, at 1:30 p.m., noticz of said hearing having been duly given as required by lar~ and in accordance with the provisions af the Anaheim Municipal Code, to hear and consider evidence for and against said amendment to the conditions of approval and modificati~n tn the use of the property, and to investigate and make findings and recommPndations in connection therewith; and WIiEREAS, said Commission, after due consi~?eratior., inspaction, investiga~iun and study made by itself, and after due consideration of all evidence and reports offered at said public hearing, DOES HEREBY FIND: 1. That no one indicated their presence at said public hearing in opposition; and that no correspondence was rece.ived in opposition to subject request. Z• That Condition No. 4 should be amended to read: "That a maximum of eight (8) trucks witn a maximum of six (6) Soads per day per truck shall be permitted for 3 portable asphalt plant. 3• That Condition No. 6 should be deleted on the basis that the petitioner proposes to use the property as a portable asphalt plant rather than a cement plant as originally approved and, therefore, said condition is not necessary. ENVIRONMENTAL IMPACT FINDING: That a Negative Declaration was previously approved on June 1, 1981 and no furtlier action is necessary. NOW, THEREFURE BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Condition No. 4 of Resolution I3o.
