A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION POR CODIDITIONAL USE PERMIT N0. 2423 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit from ADOLFO AND MARIA SERRATO, 1317 South
Claremont Street, Anaheim, California 92805, owners of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as:
_ LOT 29 OF TRACT N0. 2005 AS PER MAP RECORDED IN BOOK 56,
-' ~ PAGES 43 & 44 OF MISCELLANEOUS MAPS IN THE OFFICE OF THE
COUNTY RECORDER OF SAID COUNTY.
WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on March 21, 1983 at 1:30 p.m., notice
of said public hearing having been duly given as required by law and in
accordance wirh the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following f.acts:
1. That the proposed use is properly one for which a conditional
use permit is authorized by Anaheim *Sunicipal Code Section 18.03.030.010 to
wit: to convert an existing garage and construct an addition thereto for a
second-family (granny) unit with waiver of the following:
SECTIONS Zg.26.066.OZQ -.finimum number and type of parking spaces
AND 18.06.050,011 (4 off-street spaces, 2 enclosed in a garage
reauired; 3 off-street spaces, 1 covered
propased)
2. That the proposed use is hereby denied on the basis that the
proposal does not comply with all applicable development standards.
3. That the requested waiver is hereby denied on the basis that no
hardship pertaining to the size, shape topography or surroundings of subject
property was demonstrated by the petitioner.
4. That the pr.oposed use will adversely affect the ad~oining land
uses and the growth and development of the area in which it is proposed to be
located.
5. That the size and shape of the site proposed for the use is not
adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and
general welfare of the Citizens of the City of Anaheim.

~"' 6. That the granting of the Conditional Use Permit under the
,°:~,';'; conditions imposed, if any, will be detrimental to the peace, health, safety
, and general. welfare oE the Citizens of the City oF Anaheim.
7. That the traffic generated by the proposed use will impose an
undue burden upon the streets and highways designed and improved to carry the
traffic in the area,
8. That three persons indicated their presence at said public
hearing in opposition; and that no correspondence was received in upposition
to the sub~ect petition.
ENVIRONMENTAL IMYACT FINDING: That the Planning Director or hi.s
authorized representative has determined that the proposed pro~ect falls
within the definition of Categorical Exemptions, Class 3, as defined in the
State EIR Guidelines and is, therefore, categorically exempt from the
requirement to prepare an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby deny sub~ect Petition for Conditional Use Permit, on
the basis of the aforementioned findings.
THE FOREGOING RESOLUTION is signed and approved by me this 21st day
of March, 1983.
