PCSj-95 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2438 BE DEN.IED WHEREAS, the Anaheim City Planning Commission did receive a verifitd Petition for Conditional Use Permit from LA PALMA BUSIiVESS YARK, P. O. Bor. 6348, Orange, California 92668, owner, & ROBERT D. MICKELSON, P. O. Box 2303, Orange, Califorr.ia 92669, agent of ce:tain real prooerty situated in the City of Anaheim, County of Orange, State of California, described as: PARCEL 7, IN 1HE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 123, PAGES 46 AND 47, OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID ORANGE COUNTY. WHEREAS, the City Planning Commission di.d hold a public hearing at the Civic Center in the City of Anaheim on May 16, 1983 at 1:30 p,m., notice of said public hearing having been duly giv~n as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed condit;onal use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and deL-ermine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.6i.050.080 to wit: to permit a billboard in the ML (Industrial, Limited) Zone with waivers of the following: a) SECTION 18.05.114 - Maximum displav area (300 square feet permitted; 672 square feet proposed) b) SECTION 18.05.116.010 - N,aximum height (36 feet permitted; 45 feet proposed) 2. That the proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3• That the size and shape of the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 4• That the granting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental to the peace, health, safety and general welfare af the Citizens of the Ciky ~f Anaheim. #0633I PC83-95 5. That one person indicated their presence at said public hearing in opposition; and t:^.at no correspondence was received in opposition to the s~bject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a billboard in the ML (Industrial, Limited) Zone with waivers of maximum display area and maximum height on an irregularly-shaped parcel of land consisting of approximately 4.1 acres located at the northeasterly corner of White Star Avenue and Armando Street; and does hereby approve the Negative Declaration from the requirement to prepare an environmantal irnpact report on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general industrial land uses commensurates with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Tnitial Study submiLted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findinqs is on file in the City of Anaheim Planning Department. NOW, THEREFORE, BE IT RESOLVED that the Anaheim Ci.ty Ylanning Commission does hereby deny subject Petition for Conditional Use Permit, on the basis of the aforementioned findings.
