PC84-239 A RCSOLUTION OF THE PLANNING COMMISSION UE' THE CITY Or' ANAHEIM APPROV~.NG A UNE YEAR EX'~I'ENSION OF '1'IMF P'OR CONDI'iJQNE1L USF: PF~FtMIT N0, 210b WHEREAS, t:he klanning Commis~iun of the City of Anaheim heretofore adopted Resolution No. PC80-158 on S~ptember 2'l, 1980, ar~proving Conditional Use Permit tio. 21J6 to permi t avi.aries at 25?.Q and 2526 West Cleacbcoak Lane; and WIiEFEAS, Condition No. 2 set forth in Resclution No. PCAO-158 g~anted the usA for a maximum of 75 birds on eaeh lc~t foc a per.iod of one (1) year subject to review ~or possible extensions of time to determine if the use has had a d2trimen~al. impact ~n the surrounding resi~ential area; and WHEREAS, thce~ pre~~ious e~t~nsion~ of time have been gr.anted, the last having expired September 22, 1984; and WEiEFtEAS, the permittee , Ruth Enylish, propert,y owner, has her~tofore filed an application for an extension of said time lirnitation pursuar.t tu the provi,sions of Secticn 18.03.U93 of the Anaheim Municipal Code; and WHEREAS, the nermitte~ has i.ndi~ated the aviaries at 2526 We~t Clearbrook Lane tiave been removed anc3 the exi.sting aviary ac 2520 West Clearbrook Lane contains twelve Waxbill Ei.nches; and WHEREAS, the Planning Commission held a duly noticec] p~ablic hearing on said application on Nove;nber 14, 1984, at which hearirc~ the P3.anning Commission did receive an~9 consider evidence, '~oth oral and documentary, relating thereto; and WHERr~AS, no one indic:ated their opposihion; and that nn correspondence wa petition; and WHEREAS, the ~'lanning Commission exercised in a manner n~t detrimental. to land uses nor to the public peace, hea].th, prese~nce at said public hearing in s received in oppositi~n to subject hereby finds that said usE is being th~ pacticular area and surrounding safety and genera.l welFare.
