WNEREAS, the City Planning Com.missicn did hold a public hearing at the Civic Center in the City oF Anaheim on .7une 10, 1985 at 1;30 p.m,, notice of said public heariny having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said propused conditional ~se permit and to investigal-e and make findings and recommendations in connection therewith; and WHEREAS, said Commission, aFter due inspection, investigation and study made by itself and in its behaif, and after due conaideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal r.ode Section 18,03,p30.010 co wit: to construct a cor.ycnier,ce mwrket with ofi-sale beer and wine and gasoline sa1e;;. 2• That the proposed use is t~ereby denied cn the basis that the saLe of beer and wine in conjunction with the sale of gasoline could encourage drinking and driving. 3. That the proposed use will adversely affect the adjoiniog land uses and t:~e growth and development of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use is not adeq~ate to allow the full development of the proposed use in a manner not detri.mental to the particular area nor to the peace, health, s~fety and general welfare of the Citizen~ of the City of Anaheim. 5. That the traffic generated by the proposed use will impose an undue burden upon the streets and highways designed and impcoved to carry the traffic in the area. 7• That no one indicated their presence at said pubiic hearing in opoosition; and that no correspondence was received in opposition to the subject petition. ENVIRONMEN'lAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to construct a convenience market with oEf-cale beer and wine and gasoline sales on a rectangularly-shaped parcel of la~d consisting of approxima:ely C.43 acre, located at the southeast corner of Ball Road and Knott Street, acd fucthcr descr.ibed as 3450 West Sall Road; and does hereby approve the NegativF Declaratzon upon fi~ding that it has considered the Negative Declacation together with any comments receiveC during the public review process and further finding on the basis of the initial skudy and any comments received tha~. there is no substantial evidence that the Project will have a si.gnificant effect on the environme~:t. NOW, THEF~FJRE, BE IT RESOLVED that the Anaheim City Planrting Commission does here~y deny subject Petition far Conditional Use Permit, on the basis of the ai~zementioned findings.
