WHEREAS, the City plann~.ng Commission did hold a public hearing at the Civic Center in the City of Anaheim on January 7, 1985, at 1:30 p,m,, notice of said public hearing having been duly given as reyuired by law and in accordance with the provisions of the Anaheim M.unicipal Code, Chapter 18.03, to hear and consider evidence for and against sa.id proposed variance and to investiyate and make findings and recommendations in connection therewith; and WEIEREAS, said Commission, after due inspection, investigation and study made by itself and in its betialf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the followi.ng facts: 1. That l:hc above-mentioned waiver is hereb_~ denied on the basis tt~at the parking var;ance will cause an increase in traffic congestion in the immediate vicinity and adversely affect any adjoining land uses; and that the granting of the parking vatiance will be detrimental to the peace, health, safety or ge;ieral welfare of ~he citizens of the Cil•y of Anaheim. 3. That there are nc exceptional or extraordinary circumstances or conditionc aDplicable to the pr~perty involved or to the intended use of the property that do not apply generaily to the property or class of use in the same vicinity and zone. 4• That the requested variance is not necessary for the preservation and c:njoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the propezty in question. 5• That the reqi,ested variance will be materially detrimental to the public welfare or in~urious to the property or improvements i.n such vicinity and zone in which the propecty is located. #0413r PC85-16 ~~ . t;, 6• That no one indicated their presence at said public hearing in opposition; and that no correspondence was ceceived in opposition to subj~ct oetition. ENVIRONFIENTAL I6IPACT FZNllING: That the Anaheim City Pldnning Commission has reviewed the proposal to expand a restaurant witl~ waiver of minimum number of narking spaces on a rectangularly-shaped parc2l of land consisting of approximately 0.5 acres, located at the southeast corner of Katella Avenue and West Skreet, and further described as 106p We~t Katella Avenue (Tiffy's Restaurant); and does hereby approve the Negative Declaration upon the finding that it has considered the Negative Declar.ation together with ar.y comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the enviroument, NOW, THEREFORE, BE I4~ RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Jariance on the basis of the aforementioned findings.
