EXCEpT THE EAST 40.00 FEET THEREOF. wHEIt~AS, the City Planning Commission did hold a public hearing at the c:ivic Center in the City of Anaheim on August 19, 1985, at 1:30 p,m,, notice oE said public hearing having been duly given as required by law and in accordance with the provisions oE the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence For and against said pzoposed conditional use permit and to investigate and make Lindings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due considerar »n pp ~Zi evidence a~r ~~.,~r~~ ~f.~t~d dL saio hearing, does find and determine the following facts: 1• 2hat the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.45.050.160 to wit: to construct a 7-unit addition to an existing 22-unik motel. z• That the pcoposed use is granted subject to the condition that a minimum 5-foot high fence shall be constructed along the entire length of the northerly property line (except the front setback) and that said fence may consisk of wrought iron, chain link or block, oc some combination thereof. 3• That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is pr~posed to be located. h• That the size and shape of the site proposed for the use is aciequate to allow the full development of the groposed use in a manner not detrimental to the particular area nor to the peace, health, saEety and 9eneral welfare of the Citizens of the City of Anaheim. 0600r PC85-197 5. That the gc~nting of the Conditional Use Permit under the conditions imposed, if any, wili not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That the tzaffic gene~ated by the proposed use will not impose an undue burden upon ~_he streets and highways designed and improved to carcy the traffic in the area. 7. That two persons indicated their p~esence at said public heariny in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal. to construct a 7-unit addition to an existing 22-unit motel on a rectangulazly-shaped parcel of land consisting of aoproximately 0.51 acre, having a fcor.tage of approximately 75 feet on the west side of Beach eoulevard and being located approximately 360 feet north of the centerline of Ball Road and further desccibed as 913 South Beach Aoulevard (Robinhood Motel); and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration together with any comments ceceived ducir.y the public review pcocess and further finding on the basis of the initial study and any comments received that there is no substantial evidence t:iat the Qroject will have a significant effect on the environment. NOW, Ti~EP.EFURE, BE IT RESOLVED that the Anaheim City Planning Commission does he[eby g[ant subject Petition for Conditional Use Permit, upon the followi~ig cenditions whicli are heceby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welf.are of the Citizens of the City of Anahei.m: 1. That ptior to issuance of a building permiC, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings. 2. That the e~isting 6-foot high block Wall adjacent to the west property line shall be pecmanently maintained by the owne[ of subject property. 3. That all ait conditioning facilities and other roof and ground mounted equipment shall be properly shielded from view, and the sound buffered from adjacent cesidential properties. 4. That subject property shall be developed substantially in accordance with pians and specificatiuns on file with the City of Anaheim msrked Exhibit Nos. 1 thtough 3; provided, however, tl~at a minimum five (5)-foot high fence shall be constructed along the northerly property ].ine (except foc the f~ont setback) and that said fence may consist of wrought iron, chain link or concrete block, or some combination theceof. 5. That prior to final buildiny and zoning inspections, Condition Nos. 2, 3 and 4, abovA-me~tioned, shall be complied with. _Z_ PC85-197 __,.. BE IT FURTH6R RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoptiun of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part tt~eceof, be declaced invalid or unenforceable by tt~e final judgment of any court of competent jurisdiction, then this Resolution, and any apptovals herein contained, ~hall be deemea null ard void.
