RESOLU'i'ION OF TIiE nNAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL OSE PERMIT N0. 2709 BE DENIE,~ WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit frorn MARTIN LUTHER HOSPITAL, INC., 1830 West Romneya Drive, Anaheim, California 92602, ownet, and ROBERT D. MICKELSGN, P. 0. Box 2303, Grange, C:, i:ornia 92669, agent for c?rtain real property situated in the City of t~naheim, County oE Orange, State of California, described as: LUT 25 OF TRACT 3812, AS PER MAP RECORDED IN BOOK 146, PAGES 1 THRU 3 OF b1I5CELLANEOUS MAPS, IN THE OFFICG OF THE COUNTY RECORDER OF SAID COUNTY. WHEF.EAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on July 22, 1985 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim tdunicipal Code, Chapter 1II.03, to hear and consider evidence for and against said proposed ~onditional use permit and to investiaaCe and make findings ~nd zecortimendations in connection therewi.th; said public he~riny I~aving been continued to the Planning Conwiission meeting of September 16, 1985; and WHEREAS, said Commi.ssion, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offe:ed at said hearing, does find and determine the following facts; 1. That the proposed use is properly one for whi~L a cn~~i~:ion.~l use permit is authorized by Anaheim biunicipal Code SecCion 18.34.050.020 to wit: to permit a social cehah~.i:~w~ion center for chemical dependency in the Rt•i-12UU (Residential, Multiple-Family) Zone wil-h waiver of: SGCTIONS 18.U6.080 - Required location of parkinq spaces. 18.06.010.017 (9 on-site spaces renuired; 9 off-~ite AND 18.39.06G.010 spaces proposed) 2. The the requested parkinq iraiver is hereby denied on the basis that there is an =_,,;~ting parkiny problem in the area, and also on the basis that the parking variance could cause an inerease in traffic cong~stion in the immediate vicinity and adversely affect any adjoining land uses and would be detrimental to the peace, health, safety or general welfare of the citizens of thp City of Anaheim. 3. That the proposed use is hereby denied on the basis that it will adverse?y aFfect the ad~oining land uses and the growth and developmeat of the area and could create a financial burden on apartment complex owners in the area due to vacancies; and also un tha basis that there is adeguate room on the hospital's propetty to establish a pilot pr~gram and create a positive record to present to the neighbors to deter L•heir feacs and opposition ko the use. 0612r PC85-206 's . . . _ . ._ . ,.... :. _ 't: ~ ~-. 4• That the proposed use will adversely affect the adjoining land uses and the growth and development oE the area in which it is proposed to be located. 5• That the size and shape of the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6• That Lhe yranting of the Conditional Use Permit under the conditions imposed, if any, will be detrimental t~ the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7• That the traffic generated by the proposed use will impose an undue burden upon the streets and highways design~d and improved to carry the traffic in the area. 8• That 31 persons indicated their. presence in o~position at the July 22, 1985 meeting, and 9 persons indicated their presence in favor of the request at the August 19, 1985 public hearing, and 30 persons indicated their presence at the September 16, 1985 public hearing in opposition; and that petitions containing approximately 399 signatures were received in opposition to tl~e subject petition. ENVIRONMENTAL IPIYACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to permit a social rehabilitation center for chemical dependency in the RM-1200 (Residential, Multiple-Family) zone with waiver of required location of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 7,560 square feet, havir.g a frontage of approximately 72 feet on the north side of Neighbors Street, and further described as 1817 West Neighbors Avenue; and does hereby approve the Negative Declaration upon finding that it has considered the Negative ueclaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the projecc will have a significant effecC on the environment. NGW, THt;REFURE, BE IT RESOLVED that the Anaheim Citv Planning Commission does hereby deny subject Petition for Conditional Use Permit, on the basis of the aforementioned findings.
