FILED iN BOOK 187 PAGES 20 THROUGH 24 OF Pr`.RCEL MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. wHEREAS, the City Pianning Commission did hold a publir_ hearing at thH Civic Center in the City oE Anaheim o^ October 28, 1985, at 1:30 p.m„ notice of s.id public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal ^~de, Chapter 18.03, to hear a:id consider evidence for and against said proposed conditional use permit and ta investigate and make findinys and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due conside[ation of all evidence and repoct5 offered at saia hearing, does find and determine the foliowing facts: 1. That the requested waiver is hereby granted on the basis that the parking waiver will not cause an increase in traffic congestion in the immediate vicinity nor adversely af.fect any adjoining tand uses anr~ grantiny of the parking waiver under the conditions imposed, i: any, will not be detrimental to L•he peace, healtt;, safety and general welface of the citizens of the City of Anaheim. 3. That the propoced use will not adversely affect the adjoining , land uses and the growth and developmenc of the area in which it is proposed to be located. 4. That the grantiny of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general wel£are of the Citizens of the City of Anaheim. 6. That the traffic generated by the proposed use will not impose an undue bur.den upon the streets and highways designed and improved to carry the L•raffic in the area. 7. That no one indicated their presence ac said public heacing in opposition; and that no coccespondence was received in opposition to the subject petition. ENV?RONMENTAL I[dPACT FINDING: That the Anaheim City Planr,ing Commission has reviewed the proposal to permit construction of a corporate office with a non-industrial training facility with waiver of minimum number of parking spaces on an irceyularly-shaped parcel of land consisting of appreximately 6.2 acres having a frontage of approximately 207 feet on the southeasterly side of Sanderson Avenue, and being located approximately 340 feet south of the centerline of Taft Avenue; a~d does hereby apprcve the Negative Declaration u?on findina that it has considered the Negative Declaration together with any commer.ts received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project w:ll have a significar~t effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the A~aheim City Planning Commissio~i does hereby grant subject Petition for Conditional Use Permit, upon the following conditions whi.ch are hereby found to be a necesaary prerequisite L-o the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That prior to issuance oE a building permit, the appropriatp traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings. 3. That drainage of subject property shall be disposed of in a manner satisfactory to Lhe City Engineer. That prior to commencement of strucr.ural framing, fire. hydrants shall be installed and charged as requi-ed and determined to be necessary by the Chief of the Fire Department. 6. That prior to issuance of a building permit, pcimary water main fees shall be paid to the City of Anaheim, in an amount as determined by the Office of the Utilities Genecal Manager. , 8. That in the event a parcel map is recorded on subject propert,y, a reciprocal access and parking aqreement, in a form satisfactory to the City Attorney, shall be recorded with the Office of the Orange County Recorder. A copy of the recorded agreement shall then be submitted to the Planning Department. 9. That the dziveway shall be constructed to accommodate ten (10) foot radius curb returns as required by the City Traffic Engineer. 10. That all air conditioning facilities and other roof and ground mounted equipment shall be propetly shielded from view, and the sound buffered frort: adjacert residential properties. 11. That the pr.oposal shall comply with all signing requirements of the N1L Zone, unless a variance allowing sign waivers is approved by the Planning Commission or City Council. 12. That subject properl•y shall be developed substantially in accordance with plans an~ specifications on Pile with the City of Anaheim marked Exhibit Nos. 1 through 3. 13. That prior to issuance of a building permit, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 1, 3 and 8, above-mentioned, shall be complied with. Extensions for Eurther timr to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. lA. That prior to Final building and zoning inspections, Condition Nos. 2, 4, 6, 9, 10 and 12, above-mentioned, sha11 be compl.ied with. BE IT FUR2~~IER RESOLVED that the Anaheim City Planning Commission does hereby find and determi~e that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove ~et forth. Should an1 ~uch conditions, or an,~ part• thereof, be declared invalid oc unenforceable by the final judgment of any court of competent jutisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
