WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 13, 1985, at 1:30 p.m., notice of said public nearino having been duly given as required by law and in accordance with the provisions of the Anaheim Mun~cipal Code, Chapter 18.03, to heac and consider evidence for and against said propose9 variance and to investigate and make findings and recommendations in connection therewith; and WFIERGAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due cc,nsidecation of all evidence and repocts offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes waiver of the following to construct a one-story outpatient surgical facility isi the CL (COmmercial, Limited) Zone: SECTIONS 18.06.050.0211 - Minimum ni~m~er of parkinq spaces. 18.06.080 AND (601 spacc_s required; 493 spaces proposed) I8.44.065.050 2. That the above-mentioned waiver is hereby granted on the basis ci~ac tne parking waiver will not caus~ an incre<::e in traffic co~gestion in the immediate vicinity nor adversely aifect any adjoining land uses and yranting of the parking waiver under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the citizens of t:~e City of Anaheim. 3. That there are e~tceptional or extraordinary circumstances or conditions applicable to the property involvecl or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 4. That the requested variance is necessary for t.he preeervation and enjoymen~ of a substantial property right possessed by other propercy in the same vicinity and zone, and denied to the property in question. 5. ENVIRONt4ENTAL IMPACT FINDING: That the Anahei.m City Planning Commission has reviewed the proposal to construct a one-story outpatient surgical facility in the CL (Commercial, Limited) Zone with waiver of minimum number of parking space~ on a rectangularl}~-shapeo parcel of land consisting of approximately 5 acres, located northeast of the northeast corner of Romneya Drive and Coronet Avenue, and fur~her described as 1R01 West Romneya Drive; and does hereby approve ttie Negative D~.clara~ion upon f.inding that it has consiZered the Nega*_ive Declaration together with any comments received during the public review process and furthe~ finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect. on the environment. NOW, THEREFORE, BE IT RESOLVED that ~he Anaheim City Planninc Commission does t,ereby grant subject Petition for Variance, upon the following conditions which are hereby fo~~nd to be a necessary prerequisite Lo the proposed use of the subject property in order to preserve the safety and general welfare oE the Citizens of the City of Anahei.m: 1. That prior to issuance of a building permit, the appropriate traf.fic signa2 assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for new commercial buildings. 2. That prior to commencement of strucL-ural Lraming, fire hydrants shall be installed and charged as required and determined to be nece~sary by the Chief of the Fire Department. 3. That subject property shall be served by un~erground utilities. 9. That the owner of subject property shall pay to the City of Anaheim a fee for stree~ liyhting along Romneya Drive and Medical Center Drive in an amount as determined by the City Council. 5. That the owner of. subj?cr n~~~,~-t1 ~h~ll ~ay to the City oI Anai~eim a fee for tree planting purposes alung Romneya Drive and Medical Center Drive in an amount as determined by the City Council. 6. That fire sprinklers shall be installed as requiced ~y the City Fire Mar.sl~all. 7. That in the event subject property is to be divided for the purpose of sale, lease, or financing, a parcel map to record the appro•red division of subject property shall be submieted to and approved by the City of Anaheim and then bP recorded in the Office of the Orange County Recorder. 8. That in the event a parcel maa is recocded on subject property, a reciprocal access and parking agreeme~t, in a form satisfactory to the City Attorney, shall be recorded with the Offi.ce of th~~ Orange County Recorder. A copy of the recorded agreement shall then be submitted to the Planning Department. ~3- PC35-244 ,~ 9. That all driveways shall be constructed to accommodate ten (10) foot radius cucb returns as required by the City Traffic Engineer. 10. That t~ash storage a[eas shall be provided and maintained in accordance with appcnved plans on file with the Street Maintenance and Sanitation Division. 11. That all air conditioning facilities and other roof and ground mounted equipment shall be propetly shielded from view. 12. That the proposal shall comply with al: signing cequirements of the CL Zone, unless a variance allowing sign waivers is app[oved by the Planning Commission or City Co~~ncil. 13. That subject propecty shall be developed substantially iti accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 3. 14. That p~ior to issuance of a bui.lding permit, or within a period of one year from the date of this resolution, whichever occurs first•, Condition Nos. 1, 4, 5, 10 and 11, above-mentioned, shall be complied with. E~tensions for furthec time to complete said conditions may oe granted in accordance with Section 18.03.09C of the Anaheim Municipal Code. 15. Tha~ p~ior to final building and zoning inspections, Condition Nos. y, 10, 11 and 13, above-mentioned, shall be complied with. 9E IT FJR'PHER RESOLVED that the Anahei.m City Planning Commission does heceby find and determine that adoption of this Resolution is expressly peedicated upon applicant's complian~e with each and all of the conditions heteinabove set forth. Should any such conditinn, or any part theceof, be declared invalid or unenfocceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein rontained, shall be deemed null and void.
