PC85-252 A RESOLUTION OF TH~ ANAHEIM CITY PLANNING COFIMISSInN THAT PETITIOC7 FOR RECL•ASSIFICATION NO. 85-86-13 BE GRANTED WHEREAS, the Anahei.m City P]anning Commission did receive a verified petition Eor Reclassification from ANAHETM HILLS DEVELOPMENT CORPORATION, ~/o THE GUNSTON I~ALL COMPANY, INC., 6507 Serrano Avenue, Suite B, Anaheim, California 92gp7, ATTN: GEORGE F. MASON, JR., owner, and CHAPARRAL DEVELOPMENT, INC., 21941 Herencia, Mission Viejo, Califurnia 92692, ATTN: RICHARD N. HUDSON, agent for certain real p.roperty situated in the City of Anaheim, County of Orange, StatE of California, described as follows: PARCEL 2 IN 1•HE CITY OF ANAHEIM~ COUNTY OF ORANGE, STATE OF CALIFORNIA AS PEk MAP RECORDED IN BOOt 141, PAGES 14 AND 15 OF PARCEL MAPS, IN :HE OPFICE OF THE; COUNTY RFCORDER OE SAI~ COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 13, 1985 at 1:30 p,m „ notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim M.unicipal Code, Chapter 18.03, to hear and consider ev.idence for and against said proposed reclaesification and to i.nvestigate and make findings and recommendations in connection therewith; said public hearing having been continued to the Planning c:ommission meeting of NoveRber 25, 1985; and WHEREAS, said Commission, after ~ue inspection, investigation and study made by itself and in its behalf, and a.fter due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from RS-HS-43,000(SC) (Resident;al, Single-Family, Hillside Scenic Corridor Oveclay) Zone to the Rp1-3000(SC) (Residential, Multiple-Family, Scenic Corridor overlay) Zone. Z. That the Anaheim General Plan designates subject property for hillside low c~ensity residential land uses. 3. That the proposed reclassificatzon of subject pcoperty is necessary and/or desirable for the orderly and proper development of the comr~unity. 4. That the propo~ed reclassific::tion of subject property does properly relate to the zones and their permitted uses loca2ly established in close proximit~ to subject property and to the zones and their permitted uses generally established throughout the community. 5. That two person~ indi~al•ed tY~eir presence at said public hearing in opposition; and that no cocrespondence was received in opposition to subject petition. PC85-252 ~ ENVIRONMENTAL IMPACT FINDING: That Lhe Ananeim City Planning Commi~sion has reviewed the proposal to reclassify subject property from the RS-HS-43,000(SC) (Residential, Single-Fami.ly, Hillside Scenic Corridor Overlay) Zone to the RM-3000(SC) (Residential, Multiple-Family, Scenic Corridor overlay) Zone to c~~nstcuct a 2-story, 16-unit condominium subdivision with waivers of mar.imum structural height, niinimum landscaped setback, and required site screening on a. landlocked, irregular~y-shaped parcel of land consisting of apprcximately 3.35 acres, located approximately 600 feet east of the centerline if Imperial Highway, approximately 280 feet south of the southerly terminus of Frontiec Court, and immediately northwest of the Southern Califocnia Edison Company easement; and does hereby approve the Negative Declar.ation upon finding that it has considered the Negative Declaration to7ether with any comments received during the public review process and furt~c: finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREF~ORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Yetition for Reclassification and, by so doing, that Title 18-ZOning of the Anaheim Municipal Code be amended to exclude the above-described property from the RS-HS-43,000(SC) (Residential, Single-FaR.ily, Hillside Scen:c Corridor Overlay) Zone and to incorporate said described pcoperty into the RM-3000(SC) (Residential, Multiple-Family, Scenic Corcidor Overlay) zone upon the following conditions which are hereby four,d to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare oE the Citi.zens of the City of Anaheim: 1. That an ordinance rezoning subjecY. property shall in no event become effective except upo~ or foiloving the recordatio^ of a final map within the time specified in Government Code Section 66463.5 or such furkher time as tt~e Planning Commission or City Co~ncil may grant. 2. That prior to the introducti~n oE an ordinance rezoning subject property, Condition No. 1, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission unless said conditions are complied with within one year from the date of this resolution, or such further time as the Planning Commission may grant. BE IT FURTHLR RESOLVED that the Anaheim CiY.y Planning Commission does hereby find and determine that adoption of this Resoluti~n is expre~sly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condikion, or any oart thereof, be declaced invalid or unenforceaSl~ by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. -2' PC85-252 ~-.
