PCdS-258 A RESOLUTION OF THE ANAHEIM CZTY YLANNING COMMISSION THAT PETITION FOR RECLASSIFICATZON N0. 85-86-8 SE GRANTEU WHEREAS, the Anaheim City Planninq Commission did receive a ve~ified petition fos Reclassification fcom I,ARRY ALVZN TORGERSON AND DINAH LYNNE TORGERSON, 216 Nocth Claudina Street, Anaheim, California 92805, owners, and CITY OF ANAHEIM, 200 South Anaheim, California 92805, ATTN: NORMAN J. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on Octobec 14, 1985 at 1:30 p.m., notice of said public nearing having been duly given as required by law and in accordance with the provisions of the Ananeim t4unicipal Code. Chapter 18.03, to hear and considec evidence for and a5ainst said proposed reclassification and to investigate and make findings and recommendations in connection therewith; said public hearing haviny been continued to the Planr~ing Commission meeting of December 9, 1985; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideratioa of all evidence and reports offeced at ~aid liearing, does find and deter~ine the following facts: 1. That the petitioner proposes ceclassification of subject property from the CG (Commeccial, General) to the RM-1200 (Re~idential, Multiple-Family) Zone. 2. That the Anaheim General Plan designates subject pcoperties for medium density residential land uses. 3. That the pcoposed reclassification of subject property is necessary and/o~ desirable for the o[derly and pcoper development of the community. 4. That the neoposed teclassification of subject pcoperty does ptoperly relate to the zones and their permitted uses locally established in close oroximity to subject propecty and to the zones and their permitted uses generally established ~hroughout the community. 5. That the proposed reclassification of subaect pcoperty requires the dedication of abutting alleys in accozdance with the Circulation Element of the General Plan, due to the ant;..~pated inccease in t[affic which will be genetated by the intensification of land u~e. ENVIRONMEC7TAL IMPACT FINDING: That the Anaheim City Plan~ing Commission has reviewed the proposal to reclassify sub;ect ~,r.operty from the CG (Commercial, General) to the RM-1200 (Residential, Multiple-Family) Zone on a rectangularly-shaped parcel of land consisting of approximately O.fi3 acre located at the southeast cozner of Cypress Street and Claudina Street, and Eurther described as 210, 216, 220 and 226 North Claudina Street; and does hereby approve the Negative Declaration upon finding that it has consideted the Neqative Declaration together ~ith ~ny comments received during the public review process and further finding on the basis of the initial study and any comments received r_hac there is no substantial evidence that the project will have a significant effect on the environment. CommissionOW~ THEREFORE, BE IT RESJLVF.D that the Anaheim City Planning does hereby yrant subj~;; petition for Recla~sification and, by so doing, that Title 18-ZOning of the Anaheim Municipal Code be amended to exclude the above-described ~roperty from the CG (Commercial, General) and to incorporate said described property to the RM-1200 (Residential, Multiple-Family) Zone upon the folloNing conditions which are heteby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and geneca] welfare of the Citizens of the City of Anaheim: 1. That the owner of subject prcperty shall irrevocably offec to dedicate to the City of Anaheim a strip of land 10 feet i~ width from the centerline of the alley along the alley for alley widening purposes. 2.
