PC85-28 A RESOLUTION OF THE ANAHEI:4 CITY PLANNING COMMISSION THAT PE'PTTION FOR RECLASSIFZCATIOfJ NO. 84-85-22 BE GRANTED i.% WHEREAS, the Anaheim City Planning Commission did receive a verified petition for Re~lassification from JOSEPH D. GLEASON, 1655 West Broadway, Anahei.m, California 92802, owner, and W. SOMERS, 7342 Orangethorpe AvenUe, Buena Park, California 90621, ay?nt for certain teal property situated in the City of Anaheim, County of Orange, State of California, described as follows: LOT 17 OF TRACT N0. 2177 IN THE CITY OF ANAHEIM, COUNTY QF ORANGE, STATE OF CALIFORNIA, AS pER MAP RECORDED IN BOOK 59, PAGE5 36 AND 37~ PIISCELLANEOUS MAPS, IN T6% OFFICE OF THE COUNTY PECORDER OF SAID COUtdTY. WHEREAS, the City Planning commission did hold a public heasing at the Civic Center in the City of Anaheim on January 21, 1985 at 1:30 p,m,, notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code. Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings ar.d recommei~dations in connection tt~erewith; and WHEkEAS, said Commission, aft~r due inspecl-ion, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the followir.g facts: 1. Ti;at che petitioner proposes reclassification of subject pcoper:y Erom the RS-7200 (Residential, Single-Family) Zo~e to the CO (COmmercial, Office and Professional) Zone. ~• That the Anaheim General Plan designates subjec:t property for general commercial land use:s. 3• '1~I~at the proposed reclassification of subjec:: property is necessary and/or desirabl~e for the orderly and proper development oE the community. h• That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established ir. close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5• That the propose~ reclassification of subject property requires the dedication of abutting streets in accordance with khe Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by ::he intensification cf land use. 6• That no one indicated their presence :it said public hearing in opposition; and that no correspondence was received in opposition to subject petition. #0425r. PC85-28 ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviEwed the proposal to reclassify subject property from the RS-7200 (Residential, Single-Family) Zone to the CO (Commercial, Office and Pr.ofessior.al) Zone to permit an utfice use in a residential structure on a rPCtar.gularly-shaped parcel of land consisting of 7,080 ~quare feet located at the northeast curner of Sumac Lane and Euclid Street and further describe~ as 1695 We~t Sumac Lane; and does hereby approve the Megative Declaration upon finding that it has considered the Piegative Declaration together with any comments received during the public review process and furthec finding on the basis of the initial study and any comments received that there is nu substantial evidence that the project will have a significan~ effect on the enviconment. N~h, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Reclassification and, by so d~ing, that Title 18-ZOning of thc Anaheim Municipal Code be amended to exclude the above-described property from the R5-7200 (Residential, Single-Family) Zone and to incorporate said described property into the CO (Commercia7, Office and Professional) Zone upon the following conditions which ' ace hereby found to be a necessary prerequisite to the proposed use of subject ~~ property in order to preserve the safety and general welfare of the Citizens ~_ of the City of Anaheim: 1. That the vehicular access rights to Euclid Street except at street openings, si,al~ be dedicated 'co the City of Anaheim. 2. That prior tc the introduction of an ordinance rezoning subject propecty, Condition No. 1, above-mentioned, shell ~e completed. The provisions or riyhts granted by thi~ resolution shall become null and void b~ action of the Planning Com~ission unless ~aid conditions ace complied with within one year frcni the date of this resolut:ion, or such further time as the P'_anning Commission may grant. BE I:: FURTHEk RESOLVED that the Anaheim City Plann.ing Conmi:~sion does hereby find and determine that adoption of this Resolution is expre~ssly predicated upon applicant's compliance with each and all of the ~ondit:ions hereinabove set forth. Should any suct~ condition, or any nart thereof, be declared invalid or unenforceabl2 by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed nu.ll and void.
