WHERFAS, the City Planning Commiss;on did hold a public hearing at
the Civic Center in the City of Anaheim on January 21, 1985, at .1:30 p,m „
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim t~,~nic.ipal Code, Chapter I8,03,
to hear and consider evidence foc and against said proposed variance and to
investigate and make findings and recor,unendations in connection therewith; and
WHER~AS, said Commis:ion, aft-:r due inspection, invesrigation and
study rtia9e by i~self ard in its behal£, and after. due consideration of all
evidence and reports otfered nt said hearing, does find and determine the
following facts:
1. That the peticiuner proposes waivers of the following to
constcuct a freestanding sign:

(25 feet pecmitted within 300 feet
residential structure;
31 feet pcoposed at 250 feet)
Z. That the above-mentioned waiver is hereby -3enied on the basis
that there are no special circumstances applicable to the property such as
size, shape, topoycaphy, location and surcoundings which do not apply to other
identically zoned pcoperty in the same vicir,ity; and that strict 3pplication
of the Zoning Code does not deprive the property of privileges enjoyed by
other properties in the identical zune and classification in the vicinity.
3. That there are no exceptional or extraordinarv circumstances or
conditions applicable to the property involved or to the intended use of the
property that do not apply generally to the pruperty or class of use in the
same vicinity and zone.
4• 2'hat the requested variance is not necessary for the
Yreservation and enjoyment of a substasitial propecty right possessed by other
property in the same vicinity and zone, and denied to the property in question.

5, That the requested variance will be materially detrimer.ta.l to
the public welface or injurious to the property or improvements in such
vicinity and zone in which the property is located.
6. That no one indicated their presence at said public hearing in
opposition; and Lhat no correspondence was received in opposition to subject
petition.
ENVZkGtJMENTAL IMPACT PINDSNG: It was noted the Planning Directoc or
his authurized representative has detecmined that the proposed project falls
within the definition of Categorical Exemptions, Class 11, as defined in the
State Environmental Impact Report Guidelin~s and is, therefore, r.ategorically
exempt from khe requirement to prepare an EIR.

aforementioned findings.
