That the peticiuner proposes waivers of the following to constcuct a freestanding sign: 5ECTION 18.05.093.U241 - Maximum heiaht of_ freestandinq siqn (25 feet pecmitted within 300 feet residential structure; 31 feet pcoposed at 250 feet) Z. That the above-mentioned waiver is hereby -3enied on the basis that there are no special circumstances applicable to the property such as size, shape, topoycaphy, location and surcoundings which do not apply to other identically zoned pcoperty in the same vicir,ity; and that strict 3pplication of the Zoning Code does not deprive the property of privileges enjoyed by other properties in the identical zune and classification in the vicinity. 3. That there are no exceptional or extraordinarv circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the pruperty or class of use in the same vicinity and zone. 4• 2'hat the requested variance is not necessary for the Yreservation and enjoyment of a substasitial propecty right possessed by other property in the same vicinity and zone, and denied to the property in question. ENVZkGtJMENTAL IMPACT PINDSNG: It was noted the Planning Directoc or his authurized representative has detecmined that the proposed project falls within the definition of Categorical Exemptions, Class 11, as defined in the State Environmental Impact Report Guidelin~s and is, therefore, r.ategorically exempt from khe requirement to prepare an EIR.
