PC85-38 A RESOLUTION OF T}IE ANAHETM CITY PLANNING COMMISSIGv THAT PETITION FOR CONUITIONAL USE PERMIT N0. 2656 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Ietition for Conditional Use Permit fcom STEWART, GREEN ASSOCZATES, 2180 East Lincoln Avenue, Anaheim, Caiifornia 92806, ATTN: KARL MEADER, owner of certain ceal property situated in the City of Anaheim, County of Orange, State of California, described as: SEE ATTACBED "EXHIBIT A." WHEREAS, the City Planning Commissi.or did hold a public hearing at the Civic Center in the City of Anaheim on Pebruary 4, 1985, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and mal:e findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by irself and in its behalf, and after due consideration of alI evidence and ceports offered at said hearing, does find an~J determine the followinq facts: 1. That the proposed use is properly one for which a condltional use permit is autP,orized by Anaheim Municipal Code Section 18.44.050.010 to wit: to permit on-sale beer and wine in a proposed restaurant with a waiver of the £ollowin9: SECTIONS 18.06.050.0231, - Minimum number. of parking spaces. 18.06.OQU (2,241 spaces requited; 1,658 spaces existing) AND 18.44.066.050 2. That the requested waivee is hereby granted on the basis that the parking variance will not cause an increase in traffic congestion in the immediate vicin~ty nor advecsely affect any adjoining land uses; and that the granting of the parking variance under the conditions imposed, if any, will not be detrimental to the peace, health, safety or general welfare of the citizens of the City af Anaheim. 3. That the proposed use is hereby granted on the basis that the proposed re~taurant is smaller, requirin9 less parking, than a previously approved restaurant and the conditiunal use permit for said la~ger restaurant will be tarminated prioc to utilization of subject use permit. 4. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 5.
