ANAHEIM CITY PLANNIN3 COMMIS:iION THAT PETITION FOR RECLASSTFICATICN N~, 84-85-18 BE GRANTEn WHEREAS, the Anaheim City Planning Commission did teceive a verified petition for Reclassification from AR':HU, STAHOVICH dND MARJORIE STAHOVICH, 805 Ramblewood Drive, Anaheim 92804, owners of certain real property situated in the City of Anaheim, County of Orange, State of California, cescribad as follows: LOT 23 UF TftACT N0, 743~ BEING A SUBDIVISION OF A PORTION OF THE SOUTHWEST QUARTER Or^ SECTION FIFTEEN (15), TOWNSHIP FOUR ~4) SOUTH, RANC'E ELEVEN (11) WEST~ S.R.B, S M., ORANGE COONTY~ CALIFGRNIA, RECORDED IN BOOK 22~ PAGE 10~ OFFICIAL MAPS OF ORANGE COUNTy, CALIFORN.IA. WHEREAS, the City Planninq Commissi~n did hold a public hearing at t}~e Civic Center in the City of Anaheim en JanuaLy 7, 1985 at 1:30 p,m,, notice of sa?d p~~~?ic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code. Chapter Z8.03, to hear and consider evi~ence for and against said proposed reclassification and to investiaate and make findings and recommendations in connection there+~ith; anci WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and aEter due consideration of all evidence and reports offered at said hearing, does find and determine the Lellowiny facts; 1• 7f~at the petitionec proposes reclassificatinn of subject property from RS-A-43,000 (Residential, Agricult~~ral) Zone to the RM-2400 (Residential, Plu.ltiple-Family) Zone. "t. That the Anaheim General Flan 3esignates subject property for low-medium density residential land ises. 3• 'lhat the proposed reclassification of sub~ect property is necessary e,n~ior desirab~e for the orderly and proper development of the community. 4• That the ptooosed reclassification of subject pr~perty does properly relate to the zones and their permitted uses locally established in close pro:cimity to subject property ~nd to the zones and their permitted use~ generally established throughout the community. 5• That the proposed reclassiEical•ion of subject property requires the dedicstion of abutting streets in accorr~ance witii the Circulation Element of the Ge.zeral Plan, duc: to the anticipated increase in c:affic which will be generated by the intensification of land use. 6• Tnat no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. #0402r PC85-OS ENVIRONMENTl.G It4PACT FZNDING: That the Anaheii.q City Pianniny Commis~ion has r2~~ewed the proposal to r?classify subject pcoperty from the kS-A-43,U00 (Residential, Agricultural) Zone to the RM-2400 (Residential, Multiple-Family) oc a less i.ntense zune to r_onstruct an 8-unit apartment complex wit:~ waiver c~f maximum structural height on an ircegularly-s~iaped parcel of land consisting of app_oximately 0.47 acre having a frontage of approximately 130 fee:t on tt~e north side of Savanna Street, and further described as 3639 West Savanna Street; and does hereby approve the Negative Declaration upon £im9ing that it has considered the Negative Declaration togetiier with any c~:~mments received during the pub.lic review process and further finai_ng on the basis of the initial study and any comments received that there is no sut-tantial evidence that the project tiill have a significant eEfect on thE environment. NOW, THERSFORE, BE IT RESO;VED that the Anaheim City Planning Commission does he•reby grant subject Petition for Reclassificakion and, by so doing, thal Titie 18-Zoning of the Anaheim Ptunicipal Code be amended to exclude the above-described property from the RS-A-43,000 (Residential, Agricultural) Zone and to incorporate said described property ir.to the RM-2400 (P,esidential, Multiple-Fami.lyt Zone upon the following conditions which are hereby found to be a necessary pLErequisite to the proposed ~ise of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: That the owner of ~ubject property shall irrevocably offer to dedicate to the City of Aaaheim a sr_rip oE land 32 feet in width from the centerline o~ the street along Savanna Street for street widening purposes. 2. That prior to the introduction of an ordinanr.e rezoning subject pcoperty, Condition tac. 1, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commis^ion ~~nless said conditions are complied with within one year from t2.: ~ate of this resolution, or such further time as the Planning Com~aission m3y grant. BE IT FURTHER RESOLVED that thA Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each an~ all of, the conditions hereinabove set f~rth. Should any such condition, or anv part thereof, be declared invalid or unenforceable tv the final judgemnt of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
