R. WHEREAS, the City Planning Commission did ho?d a public hearinq at the Civic Center in the City of Anaheim on February 2Q, 1985 at 1:30 p.m,, notice of said public hEaring having been duly given as required by Iaw a~d in a~:cordance witn tfe provisions of the Anaheim Municipal Code. Chaoter 1A.03, to near ~ind consi~er evidence for and ageinst said proposed reclassifieation and te investigate and make findings ar.d recommendations in connection therewith; WHEREAS, said Commission, after due inspection, invPStigation and study ma~e by itself and in iCs hPt~11f, ,n~ aF~... .?;,~ ;;~t;~qdc:ut,on oL aIl evidence and reports otfered at said hearing, does find and detecmine the following facts: 1. That the petitioner proposes reclassification of subject property from the RS-A-43,OOU (Residential, Agricultural) zone to the RM-2200 (Residential, Multiple-Family) or a less intense zone. 2. That the Anaheim General Plan designates subject property Eor medium density cesidential land uses. 3. That the proposed reclassification of subject property to the RM-1200 Zone is necessary and/~r desirable fcr the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zor,es and their permitted uses locally established in close proximity tc subject property and to the 2ones and th~ic permitted u~es generally established throughout the community. #0448r PC85-50 i; 5. That the proposed reclassification of subject property requires the inprovement of abut.ting streets in accocdance with the Circulation F.lemenl of the General Plan, due to the anticipated increase in trafEic which will be generated by the inte~,sification of land use. 6. That orie person indicated their pre:ence at szid public hearing in opposition; and tnat no cucrespondence was received in opposition to subject petition. ENVIRONMENTAL IMFACT PIN~ING: That the Anaheim City Planning Commission Las reviewed lhe pcoposal to reclassify subject property from the RS-A-43,000 iResidential, Agricultural) 2one to the RM-1200 (Residential, Multiple-Family) Zone to construct a 30-unit affordable apartment complex with waiver~ oE ¶inimum building site area per dwelliny unit and maximum building height on an irregularly-shaped parcel of land consisting of appcoximately O.d6 acre, having a ftontaye of app:oximately 74 feet on the rorth side of Ball Road, and having a maximum depth of approximately 538 feet and being located approximakely 1015 fe^t east of the centerline of Knott Street and further described as 3033 West Ball Road; and does hereby approve the Ne~ative Declaration upon finding that it has considered t:ie Negative Declaration together with any comments received during the public review process and fucther finding on the basis of the initial study and any commenr.s ceceived that there is no substantial evidence that the project will have a significant effect on Yhe environment. NUh', THGREF~ORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subj~ct Petition foc Reclassification and, by so doing, that Title 18-7oning cf the Anaheim Municipal Code be amerded to exclude the above-described property from the RS-A-43,000 (F.,~s?dential, Agricultu:a2) Zone ~nd to incorporate said de~cribed property into the RM-1200 (Residential, f4ultiple-F~mity) Zone upon th~ fo:lowing conditic~s which are hereby found to be a necessary prerequisite to Lhe pcoposed use of subject property in ord~er to preserve the safety and genera.l Welfare of the Citizens of the City of Anahcim: 1. That the owner of subject property sha_1 irrevocahly offer t~ ~a~i~~r~ ~~ lne ~ity ot nnaheim a strip of lar.d 53 feet in width from the centerline o£ the street along Ball Road for street aidening purposes. 2. That the ownec of subject property shall submit a letter requesting termination of ReclassiFication No. 79-80-42, Variance No. 3156, Conditioral Use Permil- No. 1337 and Tentative Tract No. 11079 to the Planning Depactment. 3. That prior to the introduction of an ordinance rezoning subject property, Condition Nos.l and 2, above-mentioned, shall be completed. The provisions oc rights granted by this ,_solution shall become null a~d void by actLon of the Planning Commission unless said conditions are complied with Nithin one year from the date of this resolution, or such further ti.me as the Planning Commission may grar.t. ~ BE IT FURTHER RESOLVED that the Anaheim City Plannin9 Commis,;ion does ! hereby find and determine that adoption of this Resolution is expressly ' pcedicated upon applicant's compliance with each and all of the conditions ! hereinabove set forth.
