PC85-54 A]iRSOLUTION OE THE ANAHEIM CITY PLANhING COMMISSION THAT YETITION FOR CONDITIONAL USE PERMIT N0. 2662 BE GRANTED WHBREAS, the Anaheim City Planning Commission did receive a verified Petition for Condit-ional ~se Permit from MUNICIPAL WATER DISTRICT OF ORANGE COUNTY, 1950 East 17th 3treet, Suite 150, Santa Ana, California 92705-0229, ATTN: STALEY E. SPRAGUE, owner, ar~d GEORGE D. KGNTNER, 7 North Fifth Avenue, Arcadia, California 91006, agent of certain real property situated in lhe City of Anaheim, County of Orange, State of California, described as: ?ARCEL 4~ ZN THE CITY OF ANAHEIM~ COUNTY OF ORANG°, STATE OF CALIFORNIA, AS SHOWN ON A MAP FILED IN BOOK 30 PAGES 48 AND 49 OF PARCEL MAPS, IN THE OFFICE OF THE COUNTY RnCORDE~ OF SAID COUNTY. WHEREAS, the City Planning Commission ~id hold a public hearing at the Civic Center in the City of Anaheim on February 20, 1985, at 1:30 p.m., notice of said public hearing havi.ng been duly given as required by law and in arcordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations i.n connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evirlence and regorts offeced at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.050.080 to wit: to permit an e~~tomobile car wash with waiver of the Following: SECTION 18.84.062.P12 - Minimum structural setback. (~C Et. required adjacenC lu La Falma Avenue; 14 to 98 feet proposed) 2. That the requested use is hereby granted and the waiver is also qranted on the basis that the subject parcel is very irregularly shaped, beino shallow with a maximum depth of only 119 feet and a width of 600 feet, and that on the basis that there are special circumstances applicable to the property such as size, shape, topography, iocation and surroundings wliich do not apply to other identically zoned property in the same vicinity; and that strict application of the Zoning Code deprives the property of privileges enjoyed by other pruperties in the identical zone and classification in the vicinity. 3. That the proposed use wil.l not adversely affect the adjoining land uses and the growtt~ and development of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for khe use is adequate to allow the full development uf the proposed use in a manner not detrimental to the particular area nor to i•he peace, hea.ith, safety and general welfare of the Citizens of the City of Anaheim. #0452r PC85-54 _ ~ 5. That the granting of the Conditional Use Permit under tt~e conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens ~f the City of Anaheim. G. That the traffic generated by the proposed use will not i.mpose an undue burden upon the stceets and highways designed and impcoved to carry the traffic in the area. 7. That no one indicated their presence at said public hearing in oppcsition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Ar,aheim City Planning Commission has reviewed the proposa] to permit an automobile car wash with waiver of minimum structural setback on an ir~egularly-shaped parcel of land co~isisting of approximately 0.57 acre having a frontage of approximately 600 feet on the south side cf La Palma Avenue, having a maximum depth of approximately 119 feet, ar:d further descr;.bed as 5800 East La Palma Avenue; and does hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration togethec with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THER6FORE, BE IT RBSOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Ose Permit, upon the following conditions which are hereby found to be a necc:ssary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That sidewalks shall be installed along La Palma Avenue as required by the City ~.ngineer and in accordance with standard plans and specifications on Eile in the Office of. the City Engineer. 2, That street lighting facilities along La Palma Avenue shall be installed as required by the Utilities General Manager in accordance with specificatiuns on Eile in the Office of Utilities General Mana9er, and cnat seeuricy in tne conu of a bond, cectificate of deposit, letter oF credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements, Said security sliall be posted with the City of Anaheim prior to issuance oE buildiny permits. The ahove-required improvements shall be installed priur to occupancy. 3. That subject property shall be served by underground utilities. 4. That prioc to issuance of a building permit, the appropriate traffic signal assessmen~ fee shall be paid to the City of Anaheim in an amount as determined by the City Council for each new commercial building. 5. That drainage of subject property shall be disposed of in a manner satis[actory to the City Engineer. 7. That prior +.o commencement oL structural framing, fire hydrants shall ba installed and charged as required and determined to be necessary by the Chief of the Fi4e Department. 8. That trasn storage :zreas shall be provided and maintained in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 9. That the developer shall reimburse L-he City of Anaheim for their portion of the cost o£ constructing a median in La Palma Avenue and shall post a oond prior to i.ssuance of building permits to guarantee said payment upon demand by the City Engineer. 10. That prior to issuance of a building nermit, primary water main £ees shall be paid to the City of Anaheim, in an amount as determined by ' the Office of the Utilities General Manager. I ~ 11. That deliveries made in the delivery area adjacent to the north wall of the carwast~ buildina shall be mace on.ly during those hours when the car wash is not in operation. 12. That there shall be no dispensing of ga~oline on subjecL property unless a separate conditi~nal use permit is appr.oved by the P:Lanning Commission or City Council. 13. That all on-site landscaoing and irrzgation facilities snall be maintained in a manner consistent wil•h City of Anuheim standar.ds. , 14. That the existing watez well Eacility on sub;ect property shall be capped or otherwise rendered safe to I.he satisfaction oi the City Water Engineering Division. 15. That prior to final building and zoning inspecti.ons, •NO parking for street sweeping° signs shall be installed as required by the Street ~,: Maintenance and Sanitation Division and in acc.ordance with specifications on file with said division. 16. That all air conditioning facilities shall be properly shielded from view, and the sound buffer.ed from adjacent residential properties. ~ ~~a 17. That prior to issuance of a building permit, or wit.hin a period of one year from the date of this resolution, whichever occurs first, Condi.tion Nos. 2, 9, 9, and 10, above-mentioned, shall be complied with. That prior to final building and zoning inspections, Condition Nos. 1, 3, 5, 6, 8, .lq, 15~ 16 and 19, above-mentioned, shall be complied ` with.
