PC 85-60RESOLUTION N0. PC85-60 A kESOLUTZON OF THE ANAHEIM CZTY PLANNING COMMISSION AMENDING RESOLUTION N0. PCBS-26, NUNC PRO TUNC~ IN CONNECTION WITH VARIANCE N0. 3456 WHEREAS, on Janua~y 21, 1985, the Anaheim City Planning Commission granted Variance No. 3456 (Resolution No. PC85-26) to permit construction of a 14-unit (POrtion A? and 26-unit (Portion S) apartment complex for the handicapped with waivers of minimum number and type of parking spaces and minimum floor area on an irregularly-saapfdo ~a°el of land consisting of approximately 1.7 acres, havin9 9 ~pproximately 293 feet on the south side of Frontera Street, and being located approximately 840 feet west of the cente:line of Glassell Stceet, ar.d fucther described as 3050 East Frontera Street; and an irregulacly-shaped parcel of land consisting of approximately 1.45 acres, havin9 a frontage of. approximately 143 feet on the south side of Frontera Street, and being located apptoximately 560 feet west of the centerline of Glassell Street, and futthec described as 3060 ~ast Frontera Street; and WHEREAS, Condition c1os. 15 and 16 should have included additional wording to the effect tha~ certain covenants should be executed and recorded prior to "or concurrent with" the issuance of a building permit; and WHEREAS, Condition No. 25 should be modified deleting the requirement that Condition Nos. 15 and 16 should be co~plied with prior to issuance of a buildi~g permit; and a new condition (Nu. 27) stiould be added requicing that Condikions r1os. 15 and 16 shal] be complied with "Prior to or concurrent with the issuance of a building permit". NOW~ THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby Condition Nos. 15, 16 and 25 to read as shown below and that the new Condition No. 27 shall read as shown Uelow: 15. That prior to or concur!ent with issuance oi a building pertnit, the owner's of subject property shall execute and tecord a covenant in a form approved by the City Attorney agreeing that if in the future, the City conducts a parking study indicating a parking inadequacy, saia •~wner(s) will restripe the parking areas to accommodate lU-foot wide parking spaces and ceduce the ~ize of the passen9er dcop-off. areas to provide additionul parking spaces, as recommended by rhe City Traffic Engineer. 16. That the tenancy of each a~actment unii in the subject propecty, with the exception of the manager's unit, shall be restricted to persons at lenst. one (1) of whom in each unit is either a handicapped person or at least sixty-two (62) years of age. The "handicapped person" herein shall mean a person having a physical oc mental impai[ment which (1) is expected to be of lonq-continued and indefinite duration, (2) substantially impedes liis or her ability to live independently, and (3) is of such nature that uuch ~bility could be impruved by more suitable housing conditions. ~;'.i PCBS-60 ~0444r ~ ,Ir ..... . . . ... . . ~ . . . . Prior to or concurrent with issuance of a building permit, the owner of the property shall record a covenant against the property in a focm approved bg the City Attorney so limfting such occupancy. A copy of said recorded covenant shall be file~ with the Planning Department. 25. That prior to issuance of a building permit, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 1, 2, 3, 4, 5, 12 14, 17, 22 and 23, above-mentioned, shall. be complied with. Extensions for furkher time to complete said conditions may be granted in accordance with Section 18.03.040 of the Anaheim Municipal Code. 27. That prior to or concurrent with the issuance of a building permit, Condition Nos. 15 and 16, above-mentioned, shall 'be complied with.
