PC 85-70RESOLUTION C70. ~C85-70 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR VARIANCE N0. 3461 BE DENIED wHEREAS, the Anaheim City Planning Commission did receive a verified Petition foc Variance Erom kOBERT ALLAN 1ND CATHEP,I~E GREIG DENHOLM, 6710 East Johnstown Circle, Anaheim, California 92807, owners for certain real property situated in the City of Anaheim, Count.y of Orange, State of Califcrnia desczibed c~s: PARCEL 1, AS SHOWi: O[r A 14AP FSLED IN $OOK 67 PAGE 9 OP PARCEL MAPS~ IN THE OFFICE OF THE COUNTY RECORDER OF SAIll COUNTY, WHEREAS, the City planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on March 4, 1985, at 1:30 p.m., notice of said public 1~earing having been duly given as cequired by law ~nd in accordance with the provisions of the Anaheim Municipal Code, Cha?ter 18.03, tn hear and consider evidence for and against said proposed variance ar~d to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Conmission, after due inspection, invectigation and study made by itself and in it~ bAF~lf, and afCer due consideration of all evidence and reports ofEere~ at said hearing, doee find and determine the following facts: establishla twoh(Z)-loc s ngle lfam J~~D ubd vision l~ers of the folloaing to SECTION 18.26.061.010 - Minimum lot area (7200 sauare feet tequired; 6331 square feet proposed for Parcel I~), SECTION 18.26.061_020 - Minimum lor y.i.~~ti ~r~ Lrcn~a e(7~p =_~et cequired; 55 feet oroposed for Parcel A). That the ahove-mentioned caaivera are hereby denied on the basis that on the basis that there are no special circumstances applicable to the property sach as size, shaFe, topography, location and surcoundings which do not appl~+ to other identically zoned property in the ~ame vicinity; and that strict application of the Zoning Code 9oes not deprive the property of privileges enjoyed by other properties in the identical zone and classification in the vicinity and further on the questionable stability ap the slopes, 3• That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply genecally to the property or class of use in the same vicinity and zon~. 4• That the requested variance is not necescary for the preservation and enjoyment of a substantial property right possessed by ol•her property in r the same vicinity and zone, and denied to the propc•rty in quection. ! , t0465r ~ PCBS-70 5. That the requested variance will be materially detrimcntal to the public welfare or injurious to the property or impcovements in such vicinity and zone in which the property is located. 6. That three perso~s indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. E~VIRONt4ENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to establish a two (2)-lot RS-7200 (SC) single-family subdivis;.on with waivers of minimum loE area and minimum lot width and frontage or, an irregularly-shaped parcel of land consisting of approximately 0.37 acre having a frontage of approximately 114 feet on the south side of Johnstown Circle, and further described as 6710 East Johnstown Circle; and does hereby approve the Negative Declaration upon the finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the ini.tial study and any comments received that there is no substantial evidence that the project will h~~e a significant effect on the enviroament. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition for Variance on the basis of the aforementioned findings.
