WHEREAS, the City planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on April 1, 1985, at 1:30 p.m., notice of said pubiic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and considez evidence for and agains~c said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHE4EAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reporta offered at said hear.ing, does find and determine the following iacts: +• That the proposed use is properly one for ti;tiich a ccrditionai use ~.CrmiL is auchorized by Anaheim Muni.cipal Code Section 18.45.050.130 to wit: to retain a church fellowship center with waiver of the following: SF,C'PIONS 16.06.050.022 - Minimum number of qarkinq spaces. 18.06.050.0266 (186 parkinq spaces required; none existing AND 18.45.066.050 or proposed) Z• That the requested waiver is hereby granted on the basis that the parking variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect any adjoining land uses; and that the 9rantinn of the parking variance under the conditions imposed, if any, will not be detrimental co the peace, health, safety or general welfare of the citizens of the City of Anaheim. 3• That the use permit is granted for a period of two (2) years, to expire on April 1,, 1987. 4• Thzt the proposed use will not adversely affect the adjoining land uses and the growth and deve.looment of the area in ?ahich it is proposed to be located. #0484r ' PC85-86 i 1rr..::n - . . . ~ . ..~,..,,. _,,: ~~ .. . . ~ ~ _ _ ., . ~ ..:.. , . -. ~ ~,. . ~ ~.. . ... _„ ,.._, ...... .. ... .. - __ ' - . ~ . . . . . ~ . .. , . ae~,r.m' 5- That the size and shape of the ~ite proposed for the use is adeyuate to a11oM the full development of the proposed use in a manner not detrirnental to tne particular area nor to the peace, health, safety and general welfare of L•he Citizens of the City of Anaheim. 6• That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welPare of the Citizens of Che City of Anaheim. ~• That the traEfic generated by the propose~ u=~e will not imFose an undue burden upon the s'c:eets and highways designed and improved to carry the traffic in the area. 8• That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition Lo the subject petition, ENVIRCNMENTAL IFIPACT FiNDING: That the Anaheim City Planning Commission has reviewed the proposal to retain a church fellowship center with waiver of minimum r.~rnber of parking spaces o~ an ixregularly-shaped parcel of land consisting of ~aproximately U.78 acre, located at the southeast corner of Adele Street and Anaieim Bou.levard, and further describFd as 320 North Anaheim Boulevard (Set Free Christian Fellowship); and does hereby approve the Negative Declaratio~ upon finding tt~at it has considered the Negative Declaration together with any comments ceceived during the public review process and further f.inding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significanL- effect on the E'flVlt:,:!rna.it, NOW, THbREFURE, BL•' IT RESOLVED that tfie Ar.aheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions wt~ich are hereby found to be a necessary prerequisite to the proposed use of the subject property in ocder to preserve the safety and general welfare of the Citizens of the Ci;.y of Anaheim: 1. inat tire sprinklers shall be installed as required by the City Fire hlarshall. 2. That tcash storage areas shall be provided and maintained in accordance with approved plans on file with the Street Maintenance anci Sanitation Division. 3. That the existing structure sha.ll be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Mechanical and Fire Codes as adopted by the City of Anaheim. 4. That the proposal shall comply with all signing requiremenEs of t!~e CG Zone, unless a variance allowing sign waivers is approved by the Planning Commissioa or City Council. 5. That subject property shall be developed substantial;y in accordance with plans and specifications on £ile with the City of Anaheim marked Exh:bit Nos. 1 and 2. -2- PCBS-86 6. That pcior to the commencernent of the activity autho-ized under this resolution, or within a period of one year from tt~e date of this cesolutior., whichever occurs first, Condition Nos. 1, 2, 3 and 5, above-mentioned, shall be complied wi~h. Extensions for furthez time to complete said con~itions may be granted in accordance with Section 18.03,090 of the Anaheim tlunicipal Code. 7. That said permic shall expire in two (2) years, on April 1, 1987. bE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and del-ermine that adoption of this Resolution is expressly pcedicated upon applicant's compliance with each and all of the conditions hereinabove set focth. ~huuld any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
