A R~SOLUTION OF THE ANAHEIM CITY l?I~ANNING COt~fI~SIQh
R~COMMENDING THAT THE CITX CQUNCIL OF THE CITY OF' ANAHEIM
INTRQDUC~ AND ADOFT AN ORDINANCE TO ADOPT ~~VELOPMENT AGREEMENT N0. 88-•02
"" WHLREAS, pursuant to the authority set forth in California
Government Code Section 658fi4, and Cit~ of Anah~im Ordfnar~ce No. 4377 and
Resolution No. 82R-565 (Pracedur.es ResoJ.ution), khe City has received an
applica.tion from the de~ve~oper r~ques~ing actoption of Development Agrr~ement
No. SA-02 in connection with Specific Plan No. $7-G1; and
WHEREI~S, pursuant to the California En,vir~nmental Quality Act~
Eriviranmental Impact Report No. 273, witlz a Sta~ement of Overridixig
Considerations, was certiEied by the City Couneil on June 23, 1987, in
conjuncLzon with tY.e Speci£ic Plan t~pFr.oval and the environmental impacts and
mitigation measures associated with the Highlands of Anaheim Fiills Project
were addressec? through the certification process; and that the P2anning
Aepartm~nL- staff conducted an Tnitial Stu3y and determined that no additional
impacts would :esult tront the app.roval or executiion of Aevelopm~nt AgreQment
No, 88-02 and that previously certified Environmental Impact kgpart 2do. 273,
with St;atement of Overriding Consid~rations, is adequate as thp required
enviz~nmental dociimor.,tation for adoption of said Uev~elopment Agrgem~nt No.
88-02; and tho Analxoim City Planning Commission recammended in Resolutiori Nt~,
°C 8F.-9~ that the City Council malco that deker::~ination; and
WHEREAS, in Planning Commission Resolution No. F'~88-92, the Planning
Commission made the determination Y.hat rhe develcper demonstrated eligibility
to ent~r into a deve:opment ~yreement; and
,; WHEF.EA~, pursuant~ t.o Sec~ion 2.1 oE the Procedures Resolution, ~he
i Anaha.im City Planning f;ommission did hold a punli.c hearing at the Ana`~oim
Civic Canter, Council Chamber, 200 S~uth Anaheim Boulevard, in the City of
Anaheim on March 28, 198p, at 1:~0 p.m., noL•ice of said public hearing having
;;; been duly given as required by .law and in accordance with the provisions of
,i: the An~heim Municipnl Cods, Chapter 10.03, to hear and aonsider evxdence for
' and against said developmeni: agreem~ent and to investigate and make findings
~' and recomme~ndations in cc.ni~ection therowith; and
