Whereas, on October 24, 1988, the Planni~zq Commissi,on approved
Conditional *Jse Permit No. 3081 ~o pQrmit a 7,160 squar.•e foor,, 6-unit
commerc:ial retail cente: located at the northoast corner of ttatella ~venue and
Baylass Street, and Eurther described as 1523-31 Wost Katel'la Avenu~, by
Resolution No. PC 8N-303: aaid
FTHEREAS, the petitioner has rpguestsd an am~ndment to or deletion of
Condition Nu. 13 pertaining to limited hoars of operation for said commez~cial
rel:ail center; and
WTiEREAS, khe City Planning Commxssion diQ ho].d a~ublic h~aring
at tl~e Civic Cen~,ar in Lhe City of Anaheim on April 24, 1989, a~ 1:30 p.m.,
notice of said publi~ hc~aring having bc~en duly yiven ixi accordance with the
provzsions af the Anaheim Municipal Cade, Chapter 18.03, L•o hear and considar
evidence for and against said pr~posod amenc'iment ta conditions of approval of
subj~ct conditianal use permiC and f.o investigate and make findingg and
recammendataor,s in connectioxi ther9with; and
WHEREAS, st~.id Commission, afCer duo ix~spocti.on, investigatzon anQ
study ma~3e by it3elf aud in il:s behalf., and a#~ar due consi~eration c~f a11
evidence and repnrts offered at said hearing, doe3 find and determyne the
following L•acts:
1. That the request for amendment ta haurs qf. operation 35
premature since future tenants and usee of the c~ntor have not get bsen
dererrnined.
2. :ha4: the requesL•ed amendment is Y~ereby denied and the hours of
operation ahall not be extended ~i.nce~ the contQr is adjacent to z- residential
area and ex~anded hours of opezation could bring additional traf.fic and noise
to the aroa for a;onqer period of time each day.
3. That the proposed ext,ended hours of operation wi11 adversely
~ffecr_ the adjoining land uses and the growth ancl developmant of the araa in
which it is propased to be located.
4. That the traffic generated by the requested axtendod hours of
operation will imPose an undue burd~n up~n the str~ats and hi~hways des3.gned
and improved to carry the tr~iffic in tho area.
5. That tliree poup'le xndicated their prQSerice at said public
2~garing in opposit~an; anii th~st no cur•respondenco was received in opposition
to the subject petition.
