of said public hearings having basn duly given a.s reqt~i.red by law and in

~vid~nce anc~ reports offer9d at sa~d hearing, doei find and c~etermine the
following facts:
1. 'fhat Cond3tion No. 1 of Re~solutian No. 86R-524 requires
that the Planning Co:nmission review and agprove the speciEia plan for the
drive ~hrough restaurants prior to issu~nce oE a buslding pormit.
2. x'hut the spc~cifi~ plan~ ~or subject drive-throuqh
restaurant which was conceptua].ly appraveci by the Cit,y Council under V~-riance
No. 3603 (R~solution No. 86R-524y and which inClude3 the addi'tion of 315
square feet to the previously approvod 2,100 gquar~ foot res~aurant arQ
substantially in conformax~ce witl~ t:he previous approval.
3. 'Phat no one inc1icated their pres~nce at said ptwlxc hearinq
in op~ositions and that no corxespondence was rc3cc~ived 3n opposirion to
subjeck petiGion.
