Resolution-PC 92-46RESOI,~.TION NO..~y2-4G A itESOLUTIGN OF 'CHE ANA~EIM C1TY PLANN[NG COMMISSi~N DBNYING "Tf~E REQUES'I' TO AM~ND TiiE CONDITIONS OF APPRU'VAL IN CONNECTION WIT~-1 CONDITTONAL USE PERMI'T NO. 3417 V~'HEREAC, on Juue 3, 1991 the Anaheim City Planning Commission approved Conditional Use Permit No. 3417 under Resolution Na. FC91-74 to pennit a temporary medical office triiler ut an er-isting medical complex with waiver of minimum number of parking spaces for the period of one (1~ year; and WHEREAS, Resolution No. PC91-74 adopted in conjunctiun with suid permit includes the fnll~wing two c:onditiuns: "1. 'I'hat subject medical office trailer shall be permitted to operate on-site (1) one day every week. The trailer shall bc delivered to th~ site no earlicr than 7:~() a.m. on the day of operati~n and shall be removed no later than 9:00 p.m. on the ciay of operation. The air eonclitiuner for the unit shull not be operated prior tu 7:QU a.m. 11. That this conditional use permit is granted far a period of one (1) yeur and shall terminsite on June 3, 1992." That Coc1e Enforcement has macle thirty-eight (38) contacts at the apartments t4 tlie noi th of subject pro~erty and of those tenants they contacted, eigk~t (8) residents complained of excessive noise from the MRI unit, three (3) residents complained that the truck drivers make excessive noise when delivering the trailer to the property; and two (2) of the busines~es located on subject property stated there is inAdequate parking when the trailer is parked at the location. ?.. 1'hat the approval of subject request wauld be detrimental to the peace, heatth, safety and general welfare of the Citizens of thc City of Anaheim. 3, That one (1) person indicated his presence at 5aid public hearing in oppusitioa; and that correspondence was receivcd in oppnsition to thc suhject petition. ~A1,TFORNIA ~NVIRONMFNTAi, OUA[,ITY A~1_N21NS,i,: That the Anaheim City Planr-ing Commission has reviewed the proposal fo amend certnin canditions c~f approval pertaining to the time limitation and permitted days of operation of a previously approved mob:le mcdical unit within an existing medical complex and does hereby find that the Negative Declaration previously approved in connection with Conditional Use Permit No. 3417 is adequate to servc as the required environmental documentatio~ in connect:on with this request. NOW, THEI2CFORE, IiE I'I' RESOLVED that thc Anaheim City Planning Commissi~n daes hereby deterrnine that Conditiun NoS. 1 and 11 nf Resolution No. PC91-74 shall remain in effcct ns previousl,y approved, and that the request is therefore denied.
