PC92-73 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMIS510N THAT PETITIUI~ FOR COPJDITIONAL USE PERMIT NO. 3499 ~E GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petitian for Conditianal Use Pprmit for certain real prop~rijr situated in tho Ciry of Anahe3m, County of Orar~ge, State of Californfa, describod as: LOT 9 AF TRACE N0. 3313, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CAUFORNIA, AS PER MAP REGORDED IN BOOK 107, PAf3E(S) 34 THIROUGH 37 INCLU5IVE, OF MISCEUANEOUS MAPS, IN THE dFFICE OF THE GOUNTY RECORpER OF SAID COUN'TY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anah~~m ~n June 15, 1992, at 1:30 p.m., notice Af said p~~blic hoaring having been du{y given as required by law and in accardance with the provisions of the Anahoim Mimicipal Cods, Chapter 18.03, to h~ar and consider evidence for and against said proposed conditional use permit ~nd to investig~te ~nd make findings and recommendations in connection therewitli; and WH~RE~~S, said Commission, after due insp~ction, investigation and study mad~ by itself and in its behalf, and after dus considaration oi ail evidon~e s~nd ropurts offered at said hearin~, does find and determine tho following faats: 1. 7fiat the pro~osed use is properly one for which a conditional use permit is authoriz~d by Anah~im Municipal Code Sections 18.61.050.05Q, 18.61.05U.070 and 18.61.050.072 to permit an auto leasing facility with 6,000 sq.ft. 09 auta inspoction/preparation area and an outdoor e~tomotive storage area ior a maximum of 144 vehicles. 2. That the petltioner stipulatad at ~he public hearing that the auto inspvction/proparation area has been reduced to 4,9.33 square feet. 3. That the proposed use is aroperly one for which s conditional use permit is authorized by the Zoning Code; CR1519MS -1- PC92-73 4. That tho proposed use will ~rot adverse{y affect the adjoining land uses ond the growth and development of 4he ~r~~ in which it is proposod to be located; 5. That the size and shape of ~he site fnr the propased use is adequata to alic~w the full devolopment of the prc~posecl use in a manner not detrimental to the particular ~roa ror to the peaca, health safery, and generai walfare; 6. That tho traffic g4nerated by the proposed use will nat impose an undue burden upon the streets and h`ghways designed and improved to carry the traffic in tho arsa; 7. That the granting af the c;onditiQnal us~ permit und~r tho conditions imp~sod will not be detrimontal to the peace, hoalth, safetar and general welfare of the citizens of the Ciry of Anaheim; 8, That #ho propnsod au!o leasing facility with an-site preparatian sn~ outdoor vehiclA storage is compatibl4 to the surrounding land uses and is not visible to the ~eneral public; 9. Th~t the proposed use h~s more than adequate parking for the operatir,n of the loasing facility and the outdoor vehicla starage; and 10. Tha: no one indicated their presence at said public hearing in opposition; and that no correspondenr,e was received in opposition to the aubJect petition. ,~ALIFORNiA.ENVIRQN~IENTALOi~_A~TYACTFINDING: ThattheAnaheim City Planning Commission has r~vie~-ed the proposal to permit an auto ledsinc~ faciliry with 4,933 sq.ft. of auto inspection/proparation are~ and ari outdonr automotive storage area for a maximum of 144 v~hicles on ~an irre~ularly-shaped parcel of land consisting of approximately 4.69 acres, havinr~ a frontago of approximatoly 80 feet on the south side of Palais Road, having a r~iaximum depth of ~55 ieet, being located approximately 710 feet east of the centerline of Anaheim Boulevard and furtlier described as 270 East Palais Road; and does hereby approve the Negative Declarati~n upon flndin~ that th~ doclaration reflects tha independer: judgt~m~nt of the lead ag~ncy and that R has considered tho Negative Declaratfon together with any comments recaived during th~ public review process and further finding on the basis of thc~ initial study ~nd any commonts received that there is no substantial evidencv that the proJect will h3ve a significani eHect cn tho ern~ironment. _2. PC92-73 NOW, 'fHEREFOFI~, BE IT RESOLVED tha~t the Anaheim City Planning Commission does hereby grar~t subject Petition f~r Condi~tional Use Permit, upon the follc,wing conditions which are hereby foun+~ to be a necessary prerequisito to the propased use of the subject pro~erty in orde{ ta preserve the safety and generai welfare of the Citizens of the City of Anaheim; ThA" ther~ shall be no au#omobile repair (including, but not limited to, tune-ups, oil Changes, det~iling, et:.) pormitted on tF-e premises. Only veh(cle inspection and preparation for leasing shall be allowed. 2. That a~fan Sheet for salid waste storago and collection, and a plan for recycling sh~li be submit#ed to the C~~partment of Maintenance for ravipw and ~pproval. 3. That the separ~tinn wall ~etween the proposed automotiile uses and the existir,g church shail be upgraded to the proper occupancy st~nc~ar~s, as required by the Building Division. 4. That pricr to cornmencement of the activity authorized by this resolution, rr prior to issuanae of a building permit, or within a periud of one (1) year fram the date of this resolution, whichever occurs first, Condition Nos. 2 and ~, ebove-mentioned, shall be complied with. Extensions fo~ further time to complete s~id conditions may be granted in accordt~nce with Section 18.03.090 of the Anaheim Mun:cipal Cod~. 5. TF~at subject property shall be devolopad substantially in accordanc~ with plans and specific~tions submitted to the City of Anaheim by the petitianar and which plans aro on fiio with the Planning Department marked Revision No. 1 of Exhibit Nos. ~ and 2. 6. That approv~l of this applicatior~ ccnstitutes approval of the proposed request only to the extent that it complfes with the Anahoim Municipal Zoninc~ Code and any other applicable City, St~te and Federal ~egulations. Approval does not include any action or findings as to compliance or approval ofi the request rs~arding any other applicable ardinance, regulation ar requirement. BE IT FURTHER RE:SOLVED that the Anaheim City Planning Commission does hereby flnd and determine tliat adoption of this Resolution is ;xpr~ssiy predicatect upon applicant's compliance with each and all of the conditions hereinabove set forth.
