P 4-1~4 A RESOLUTION OF THE ANAHEIM CI'TY PLANNING COMMISSION AMFNDING CERTAIN CONDITIONS OF APPROVAL OF COND!TIONAL USE PEFiMIT N0. 3511 WHEREAS, on April 6, ~1992 tha Anaheim City Planninfl Commission approved Conditlonal Use Permit No. 3511 tor iive yoars under Resol~ltion No. PC92-A5 penn~tting a church with waiver of minimum numhor oi parking spaces on property locatvd on tho west side o1 Sfnclair Stree! approximately 410 teet south of the centerline of Cerritos Avenue, and further described as 1531 South Sinr,lafr Street; and WHEREAS, safd Rosolution No. PC92-45 includes the following condition of approval: "1. That subJ~ct use pormit shall expire five (5) ye2rs irom the dato of this resolutlon; provlded, however, that time oxtensions may be requ~sted in connectlon with a public hearing and, ft a~proved, the use may continuo tor the additfonal specitfed time." WHEHFAS, an Au~wst 4, 1994, thg pot~tioner submitted a lelter stating that the current loase for the build(ng expires on October 1, 1999 and requesting delotfun of Condition Na. 1 thereby sllowing the church to remdin at subJoct lucation indatinitely. WHEREAS. the City Piannfng Cornmission did hold a public hearing at the Civlc Center in the City o( Anaholm on October 3, 1994, at 1:30 p.m., notir,e o( said public hearing having been duly given as r~quired by law and in accordance with the provisfons of the Anaheim Municipal Cocie, Ghapter 18.03, to hear ~tnd cunsider evid~nce tor and against said proposed amondment and to investigate and m~ke linding~ and rec~mmendations in conner.tion therewith; and WHEREAS, said Commission, after due Inspoction, fnvestigation and study mado by ltself and Ir~ its b~-hali, and nfter due consideration af all evidence and reports oHered at said haarinfl, does find and determine the fotlowing tacts: 1. 7hat, fn accordancs with Zoning Coc1e Subsectlon 18.6t.050.61~1, tlme Iirnitatlons are mandatory only tor churchos lucated in ttie ML Zone in tho Canyon Industrial P.rea and, ~Ithough subJect property Is zonoci ML, it is not located in thQ Canyon Industrial Area ~nd, theref~re, the timo Ifmftation is not mands~tory. 2. That subject uso pormit shall termineto on October 1, 1999, In conJunction with tho current lease ior the approved church. Should subject church obtaln a lease beyond the Octobnr 1, 1999 terminatlon date, a now conditlo~~al use pormit shall be filecJ and must be ApproveG for the churat~ to remain at subJect Iocation.
