WHEREAS, th9 City Planning Commission did hold a public hearing at the Clvic Center In the City ot Anahelm on Juno ~I, 1994, at 1;30 p.m., notice of sald pubiic hoarfng havfng been duly givon as roquired by law and in accordance with the provislons ot the Anahelm Municipal Code, Ch~ept~r 10.03, to hear and consider evidenco far and agalnst said pmposed amendment and to Investigate ~nd mako findings and recommendations in connection therewfth; and WNEREAS, sald Comm(sslon, after due inspection, Investigation and study made by itself and In its behalf, and after due cunsideration of a11 ovidence and reports oifered at said hearing, does iind and determine the follawing facts: 1. That tlie Planninc~ Commission is authorized ta considor modification of any variance at a publfc hearing ~~pon the grounds that such modiffcation, includfng tho imposition of any addftianal conditions theroto, is ~easonabiy nec~ssary to permit reason2ble operatfon unde~' the varlance as nranted. 2. The fnsteliatlon and use of a paint spray booth, when authorized by the issuance of a building permit, will not be detrimenta! to the peace, hoalth, sa(ety or wolfare of the surrounding communlty. 3. That the requosted modification of :ho previously-apProved variance is nocossary to permit re~sanable operatfon of the existing automotive repair and body shop. 4. That no one indicated th~ir presence at said public hearing in opposition; and tl~at no correspondence was roceived in opposition to the subject potition.
