P_ 127 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSICN THAT ?ETITION FOR RECLASSIFICATION NO. 96-97-02 BE GRANTEQ, UNCONDITIONALLY WHEREAS, the Anaheim Ciry Planning wmmission did receive a verified petftion far Reclass~ication for real property situated in the City of Anaheim, Coun:y of Orango, Stata of Calffomia, describes! as fdlows: LOTS 54, 55, 56, 62, 63, 64 AND THE EASTERLY RECTANGULRFI2 INCHES OF THE NORTHERLY RECTANGUTAR 20 FEET OF LOT 57 IN BLOCK 'E' OF I~EIMANN AND GEORuE'S MAP OF ADDITION BUlLDItv~ LOTS, AS SHOWN ON A MAP RECORDED IN BOOK 2, PAGE 249 OF MISCELLANEOUS RECORDS OF LOS ANGLES COUNTY, CAIJFORyIA. D(CEPTING THEREFROM THE SOUTHERLY THREE AND ONE HALF INCHES OF LOT 56. WHEREAS, the Ciry Plann(ng Commission dkl hdd a publfc hear(ng at the CNic Center in the City of Anaheim on December 9, i996 at 1:30 p.m., not(ce of said public hearin~ having been duly given as required by law and in accordance wfth the provisions of the Anaheim Munlcipai Code, Chapter 18.03, to hear and consider evidence for and against said proposed reciass~ication and to irnestigate und make flnd(ngs and recommendatfons in connection therewfth; and WHEREAS, said Commission, after due fnspaction, irnestigatlon and study made by itself ancf in fts behalf, and after due considerat(on of all evidence and reports offered at said hearing, does find and determine the following tacts: 1. That ths proposed reclassiflcation of subJect property is frc,m the CG (Commercial, General) Zone to the CL (Commercial, LJmited) Zono; 2. That the Anaheim General Plan designates subject property for General Commercia~ land uses; 3. That the reclassif(cation conforms to the Anaheim General Plan land use designation for subject property for and the reclass~ication complies with the axistinq Planning Commissfon and City Council policy to reclassiy CG "General Commercial' and CH "Heavy Commercial' zoned properties to the CL 'Limited Commercial' Zone; 4. That the proposed reclassHication of subJect property Is necessary and/or desirable for the orderly and proper development of the community; 5. That the proposed reclassification of subJect property does properly relate to tha zones and their permitted uses locally estaWished in dose proximity to subJect property and to the zones and their permitted uses generally estaWished throughout the community; and f. 7hat one person indicated his presence at said publk hear(ng in opposttion; and that no correspondence was receNe~ in cpposition to subject ~etftion. CR2794MS.WP -1- PC96-127 ae~ ~ CAUFORNIA ENVIRONMENTAL (~UALITY ACT FINDIN~: That the Anaheim City Planning Commission has reviewed the proposat to reclassffy subject property nom the CG (Commerciai, General) Zor~e to the CL (Commercial, Limfted) Zone to permft an sutomotive ~epair and body facility in tw~ existing buildings (18,235 sq.ft. total) with waiver of min(mum number of parking spaces an a rectangulary-shaped parcel aonststing of approximately 0.74 acre located at the southeast comer of Anahefm Bouleva~ and Adele Street, having approximate frontages of 135 feet on ihe east side of Anaheim Boulevard and 215 feet on the so!~th side of Adele Straet, and further descr(bed as 320 North Anaheim Boulevard; and does hereby approve th~ ~legative Declaration upen flnding that the dedarat{on reNects the independent judgement of the Iead agency and that R has considered the Negative Dedaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substaMfal evidence that the proJect will have a s(gniflcant effect on the ernfronment. NOW, THEREFORE, 8E IT RESOLVED that the Anaheim City Planning Commission does hereby approva the subject Pethion for ReclasstAcat(on to authorize an amendment to the Zonin~ Map of the Anaheim Municipal Code to exGude the above-desC~ibed property from the CG (Commerc(al, General) Zone and to incorporate said dsscribed property into the CL (Commercial, Umfted) Zone, unconditionally. BE IT FURTFiER RESOLVED that approval of this ap~lication constftutes approval of the proposed request only to the extent that ft compi(es wfth the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval dces not tndude any action or Nndings as to compliance or approval of the request regard(ng any ather applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED, that this resolutlon shall not constkute a razoning of, or a commftment by the City to rezone, the subJect property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by the Cfry Council at fts sote discretfon.
