Resolution-PC 96-14~ ~ RESOLUTION NO. PCS6-14 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUTICN N0. 90-137, AS AMENDED BY RESOLUTION NO. PC93-120, ADOPTED IN CONNECI'ION WITH VARIANCE NO. 4053 WHEREAS, on June 4, 1990 the Planning Commission adopted Resolution No. PC90-137 tn connection wfth Variance No. 4053 (wxiving permitted business signs, maximum sign height, and maximum size of sign in the parking-landscape area to construct one 780 sq.ft. freestanding sign for the auto mail located on the southeast comer of the intercharrge between Ball Road and the SR 57-Orange Freeway); and that no further ac4lon was taken by the City Councfl; ~JVHEREAS, or~ November 1, 1993 the Planning Commisston 4dopted Resotution No. PC93-120, ~mending Resolution No. PC90-137 and waiving maximum sign area to permit a 39 sq.ft. addftion to the existing 923 sq.ft. freestanding sign; and that no further action was taken by the Ciqr Cou~cil; and WHEREAS, said Resolution No. PC93-120 includes the following condition: "5. 'fhat the subJect thirty nine (39) square foot addition shall be removed within rivo (2) years from the date of this resolution, by P:ovember 1, 1995." WHEREAS, Dennis Hardin submitted a tetter, dated November 17, 1995, requesting an ~~nendment to Variance No. 4053 to delete Condftion No. 5 thereby allowing the exfsting 39 sq.ft. s(gn panel to remain permanently, and that she has indicated the request is due to a lack of vOsib;lity of the individual auto dealerships from the streets and freeways. WHEREAS, subject properry ts developed with an automobile dealership with accessory servicing in the ML "L(mfted Industrial° Zone. WHEREAS, the Ciry Planning Comm(ssion did hold a public hearing at the Civic Center in the City of Anahelm on January 8,1996, at 1:30 p.m., notice of safd publlc hearing having been duly gNen as required by law and In accordance with the provisions of the Anaheim Muni:ipal Code, Chapter 18.03, to hear and consider evidence for and against sa(d proposed amendment and to investigate and make find(ng~ and recommendatlons in connection therewfth; and that said pubtic hear(ng was continued to thc3 February 5, 7996 Planning Commission meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by ftself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does flnd and determine the following facts: 1. That no one indicated their ~resence at said public hearing in opposition; and that no correspondence was received in opposft(on to the subject petitic+n. CR2592DM.WP -~' P~14 ~ ~ CALIFORNIA ENVIRONMFNTAL QUALITY ACT FINDING: That 4he Anaheim City Planning Commission has reviewed the proposal and does hereby ~ind that the NegaYNe Declaration previou~ly approved in connection with Variance No. 4053 is adequate to serve as the required environmental documentation in connection with this request upon finding that the declaration reflects the Independent Judgement of the lead agency and that it has constdered the prevtously approved NegatNe Ueciaratfon together with any comments received during the public review process and further finding on the basis of the initial study and any comments receNed that tiiere is no substantial evidence that the project will have a signfficant effect on the environment. NOW THEREFORE BE IT RESOLVED ihat the Anaheim Planning Commission does hereby delete Condftion No. 5 of Resolution No. PC93-120, in fts entirety.
