PC95-21 ADOPTED iN CONNECTION WITFI CO~!DITIONAL USE PERMIT NO. 3745 WHEREAS, on March 6, 1995, the Planning Commission approved Conditional Use PermR No. 3745 to permft temporary modular classrooms in conJunction wfth an existing p~ate educationai facility (Servite High: Sahool); a~d that no further action was taken by the City Council; V4ne~eas, Resolution No. PC95-21, ~doptrri in connection with ~ubject uso permft~ sPecifles the follawing: 't. WHEREAS, th:• ~~:cy -'lannli~g Commission did hold a public hearing at the Civic Center In the C~'y i:= %v~aheim a~rApril 29, 19y6, at 1:30 p.m., notice of said publ(c hearing having been duly given as required by law and in accordance wfth the provisions of the Anaheim Municipal Code, ChaPter 18.03, to hear and conside:'ed~ence for and against said proposed amen~ment and to lervastigat~ and make find(ngs and recor.~mendations fn connection therewfth; and ~ WHEREAS, sald Commission, after due inspection, irnestigation and study made by ftself and tn fts behalf, and after du~ considerati~n of all evidenc9 and repoRs offered ac said hearing, does flnd and determine the following facts: 1. That subject use permit is being exercised in a manner not detrfinental to the particuia~ artla and suROUnding land uses, nor to the pub{fc peace, health, safery and general vtielfare. 2. That although temporary trailers (modular ciassrooms) are not specffica~ly 1lsted as a condftional use in the RS-A-43,000 Zone, Code Section 18.03.030.010'Untisted Uses - Permitted' provldes that uses which are not rrentioned and are similar to or compatible with permitted or conciftionally parmitted uses may appiy for a conditional use permit; and that subJect request to retsin the temporary modular unfts for an additional two years is compatible wfth the existing achod operations; that the modular untts wiil not negatNety impact the adjacent single-family residential neighbofiood; and tlxit no added traffic or parking impacts have occurred due to the modular classrooms. 3. That one person spoke at tho said ~ublic hearing in opposftion; and that no coResponde+xe v~as received in opposition to the subject petition. CE72639DM '1' PC96-42 ..~ C~AUFORNIA ENVIRONMENTAL QUALITY ACT FINDING: The Planning Director's authorized represenLaiive has determined that the proposed proJect falis wfthin the deNnition of Categorical Exemptions, Class 74, as deflned ir the State EIR Guidelines and is, therefore, categorical~y exempt from the requirement to prepare an EIR. NOW THEREFORE BE IT RESOLVED, that the Planning Commission does hereby amand Condition No. i of Resolution No. PC95-21 to read as follows: •1. That this Condftional Use Permft shall expire on September 30, 1998.'
