PC37-i A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION DENYING, WITHOIlT PREJUDICE, THE REC~UES'i TO AN'iEND COt~DiTIONAL USE PE9MIT NO. 2798 WHEREAS, on June 23, 1986 the Planning Commission adopted Resolution No. PC86-167, in connection with Conditional Use Permft No. 2798, to permft an autemotive sales/seroice center facil'ity and outdoor storaga witfi waiver of minimum number of parking spaces (138 requirad, 98 proposed) at 808- 820 ~Nest Vermont Avenue; WHEREAS, subject property is developed with a 19,168 sq.ft. commercial building in the CL (C4mmerciai, L(mited) zone; WHEREAS, the petitioner orig(nally requested a determination that establishing a secand used- car dealership would be substantially in conformance with Conditional Use Permit No. 2798 as orig(naliy approved; and that said reques' was a Reports and Recommendatfons ftem on the October 28, 1996 Planning c:~mmiss(on agenda, at which time 4he Planning Commissfon denied the request and ciirected staff to schedule the request for r~~!lc hearing; WHEREAS, the C'ity Pianning Commission did hold a public hearing at the Civic Cen:er in the C'ity of Anaheim on December 9, 1996, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accardance with the provisions of the Anaheim '~Aunicipal Cods, Chapter 18.03, to hear and consider evidence for and against said proposed ainsndment and to investigate and make findings anc! recommendatfons in connection therev~fth; and that said~ vublic hearing was continued to the January 6, i997 Planniny Commission meeting; and WHEREAS, s~:id Commission, after due inspection, invesiigatiun and study made by ftself and in its behalf, and after d~a ~onsiderat(on of all evidsnce and reports offered at said hearing, does find and determine the following facts: 1. That subJect petit+on was continued from the Fianning Commission meeting of December 9, 1996, at the request oF the petitioner, to allow additionat time to submit revised plans and to pay r2quired application fees; 2. That tne petitioner failed to submit accurata plans for Planning Commissio~ consideration in conjunction with the subject request and that the required applicatian fees wera not paid; 3. That staff has inspected the subject prope~ty an,~ determined that the petitioner has vacated the premises an~J that several attempts by staff to ~ontact the petftioner with regard to the s4at~s of this request ~iave failed; and 4. That no one indicated their presence at said public iiearing in opposition; and that no i correspondence was received in opposition to the suhiect petition. ' CAUFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Ciry Planning Commission tias reviewed the propcsa! and does hereby find that the Negative Deciaration previouslv approved in connection with Conditional Use Permit No. 279C is adequate to serve as the required ~~ environmental documentation in cennection with this request upon finding that the declaration reflects the ; independent judgement of the lead agency and tha~ it i+as considered the previously approved NegaCNe Declaration together with any comments received during the public review process and further finding on the bas(s of the initial study and any commer+ts received that there is no substantial evidence that the project will have a significant effect on the environment.
