Resolution-PC 97-101~ ~ RESOLUTION NO. PG97-101 A RESOLUTION OF THE ANA.yEIM GITY PLANNING COMMISSION AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUTION NO. 94R-217 ADOPTED IN CONNECTION WITH CONDITIUNAL USE PERMIT NO. 3691 WHEREAS, on August 23, 1994, the City Council adopted Resolution No. 94R-217 granting Cond'Rional Use Permft No. 3697, in part, to permft a church with waNer of minimum landscaping requirements; and that said resoiution induded the following condition: 8. That a landscape plan shall be submitted to the Planning Commissfon for revfew as a"Reports and ~idcommendatio~~s' item showing on-site landscaping conslsting of minimum frfteen (15) foot landscaped setback along the north edge of the property and the Code required trees to be piantsd (n the setbacks along State College Boulevard and Placentia Avenue. Installation of such landscaping may invdve relocating certain parking spaces into the proposed landscape courtyard fn front of the proposed church bullding. WHEREAS, on October 28, 1996, Plannin~ Commfssion granted a one year time excension io comply wfth the corxiftions of approval and that said extension will exp(re on August 24, 1997; and WHEREAS, this prope~!~/ ~s developed with a 10,000 sq.ft. meeting hall wfth offices (vacant) fn the CL (Commerciai, Limited) zone. WHEREAS, the appiicant, Dr. Jamat Nour, has submitted a request to amend or delete said Conditfon No. 8, and has submitted a revised sfte; landscape plan Qabeled Revlsion No. 1 of Extst;?:t":~: t), including a redesigned parlcing lot layout with a total of 108 parking spaces, 13 proposed trees along Stats College Boulevard and 8 existlng rtwture trees along Placentia Avenue, in compUance wfth Code; WHEREAS, the Cfty Planning Commission did hdd a public hearing at the Cfvic Center in fhe City of Anaheim on July 21, 1997, at 1:3C p.m., notlce.o~ said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipai Code, Chapter 18.03; to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, saki Commission, after due inspeciion, investigation and study made by ftself and in its behalf, and after due consi~eration of all evidence and reports offered at said hear(ng, does find and determ(ne the fdlowing facts: 1. That modffication of Condition No. 8 fs reasonably necessaN to protect the public peace, health, safery and general welfare, and necessary to permft reasonrble operation under the conditfonal use permft as granted; 2. That the axisting landscaping strip adjacent to the north property line, proposed to be retained and measuring 5 to 20 feet wide, provides substantial sfte screening for adjacent residential uses and preserves the existing mature trees; 3. That aithough the proposed parking layout will iower the number of parking spaces adjacent to residential uses from 28 to 17 spaces, ft will provide 108 parking spaces (mEnimum 82 s~aces required by Code) which is sufficieni for the church faciliry during fts peak use times; and CR2986PLWP -1- PC97-101 ~ ~ 4. That no one indicated their presence at said public hearing in opposftion; and that no correspondence was receNed in opposftion to tho subJect petition. CALIFORNIA ENVIRONMENTAL QUAUTY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposa~ and ~+oes hereby flnd that the Negative Declaration previously approved in connection with Conditional Use Permit Na. 3691 is adequate to serve as the required environmerrtal documentation in connection with this request upon finding that the declaration reHects the independeM judgement of the lead agency and that it has consklered th~ previously approvecf Negative Declaration together with any commeMs receP,red dur(ng the public rnview process and further finding on the basis of the inftial study and any commeMs received that there is no substantial evidence that the project will have a signiflcant effect on the environment. NOW THEREFORE BE IT RESOWED that the Anaheim Ciry Planning Commission does hereby amend Condit~on No. S of Resolution No. 94R-217, adopted in cannection with Conditfonal Use Permft No. 3691, to reacs as fdlows: 8. That a landscape plan shall be aubmitted to the Planning Commiss(on for review and approval show(ng on-ske lartdscaping consisting of a minimum Me (5) foot to twenty (20) foot wide landscaped setback along the nonh edge of the property, as shown on Pevision No. 1 of Exhibft No. 1, and that Code-required trees shall be planted in the setbac{cs along State Coilege 8oulevard and Placentfa Avenue.
