PC97-11 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLf+SSIFICATION N0. 96-97-09 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Commission did initiate a petition for real property sftuated in the City of Anaheim, Counry of Orange, State of California, described ss follows: LOTS 7, 8, 9, 10, 11 AND 12 OF THE McCARTER SUBDIVISION, LOTS 10, 11 AND 12 OF BLOCK "E" OF THE HEiMANN & SORRENSON'S ADDITION, LOTS 5, 6 AND 7 OF BLOCK "E' OF THE EYMRNN SUBDIVISION, AND LOTS 1, 10, 11 AND 12 OF BLOCK "A" OF THE HEIMANN & SORRENSON'S ADDITION OF THE WESTERLY 57 FEE1', IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 35 PAGE 17, OF MISCELUINEOUS MAPS IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. WHEREAS, the City Planning Commission dfd hold a pubiic hearing at the Civic Center in the City of Anahelm on February 3, 1997 at 1:30 p.m., notice of said publ(c hearfng having been duly given as required by law and in eccardance with the provislons of the Anahelm Municipal Code, Chapter 18.03, to hear and consfder evidence for and against safd proposed reclassification and to investigate and make findings and recommendations (n connection therewith; and that sald publlc hearEr.fl was continued to the February t9, 1997 Plannfng Commfssfon meeting; and ~NHEREAS, said Cammis~i~n, after due Inspection, Inv~stigatian and study made by Itself and In Its b~haif, and after due consideration of all evidence and reports offered at sald hearing, does find and determine the following facts: t. That the petftioner proposes reclassKicatlon o( subJect property irom the RS•5000 (Residential, Singie Family) to the RM-2400 (Residential, Mult(ple Famlly) or a less i^tense Zone. 2. That the Anaheim General Pian designates sub~ect property for Low-Medium Density Residential land uses permitted up to 18 units per gross acre resulting on a maximum of 68 units for this 3.79 acre site. 3. That the proposed reclassification oi subJect property is necessary and/or desirable tar the orderly and proper development of the community. 4. That the proposed reclassKication of subject property does properly relate to the zones and their permitted uses locally estaWished in close proximity to sub~ect property und to the zones and their permitted uses generally established throughout the community. 5. That 2 concerned people spoke at tho public hearing and submitted petitions with siSe~atures in opposition to subject proposal; and that no other correspondence was received in opposition to sub~ect petition. CR2828DM.WP -1 • PC97-11 ~ ~ CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed th9 proposal to reclassify subject property from the RS-5000 (Residential, Single Family) zone to the RM-2400 (Residential, Multiple-Family) or a less fntense zone on an inegularly-shaped parcel consisting of approximately 3.79 acres located at the nartheast comer of Cypress Street and Olfve Street with frontages of approximately 215 feet on the east slde of OINe Street and 832 feet o~ the north side of Cypress Street, and Iocated at the southeast comer of Pauline Street and Adele Street with frontages of approximately 265 feet on the east side of Pauline Street and 55 feet on the south side of Adele Street and fdrther described as 300, 304, 304 1/2, 308, 308 1/2, 312, 312 1/2, 314, 314 1/2 and 320 North Olive Street; 300, 301, 306, 3061/2, 306, 309, 310, 311, 312, 312 1/2, 315 and 317 North Sabina Street; 300, 305, 307, 312, 318 and 322 North PauUne Street; and 411, 415, A19, 421, 517, 521 and 527 East Cypress Street; and daes hereby approve the NegatNe Deciaratlon upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the NegatNe Declaratton together wfth any comments received during the publfc review process and turther Cnding on the basis of the ~nftfal study and any comme~~ts receNed lhat there Is no substanti~l evidence thxt the proJect will have a signKicant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby epprove the subJect Petftion for Reclassiflc:ation to authorfze from the RS-5,t000 (Residentlal Sa g~e the Anaheim Municipal Code to exclude the above-described property Family) Zone and to incorporate said described property into the RM•2,400 (Residendal, Multiple•Famlly) Zone, unconditionally.
