Resolution-PC 97-117~ ~ RESOLUTION NO. PC97-117 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSiON THAT PETITION FOR VARIANCE NO. 4307 BE DENIED WHEREAS, the Anaheim Ciry Planning Commission did receive a verified Petition for Variance for certain real property situated in the City of Anaheim, County of Orange, State of Califomia described as: PARCEL NO. 1, AS SHOWN ON A MAP FILED IN BOOK 85, PAGES 20 AND 21 OF PARCEL MAPS IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFORNIA. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Genter in the Ciry of Anaheim on June 9, 1997, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipa{ Cede, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and that said public hearing was continued to the Juiy 21, August 4 and August 18, 1997 Planning Commission meetings; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: Petitioner requests waivers of the following to construct two freestanding pole signs: (a) Sections 18.05.091.010 18.05.091.011 18.05.091.012 18.05.091.014 and 18.8~•.062.040 (b) Sections 18.05.091 and 18.84.062.040 Permitted freestandinq sian. One, maximum 26 sq.ft• sign on a 36-inch hiqh decorative wall containing the name of the center andlor one maior tenant permitted; two, 227 sa.n, freestanding 10-foot high monument signs with name of center and 8 tenant names proposed) Permitted tvoe of siqn. That following public notification, the petitioner withdraw the request for roof signage; 3. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or tc the intended use of the property that do not apply generaliy to the property or class of use in the same vicinity and zone; and that the underlying property has more than adequate street frontage and visibility from two adjacent arterial highways; 4. That the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the szme vicinity and zone, and denied to the properry in question, because no other significantly large freestanding monument signs with eight individual tenant panels have been permitted other similar property in tne vicinity or for other shopping centers in the CL (SC) "Commercial, Limited - Scenic Corridor Overlay" "Lone; _~ _ PC97-117 GR3023MS.W P ~ ~ 5. That the requested variance will be materially detrimentai to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located; and 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to subject petition. CALIFORNIA ENVIRONMENT~,L QUALITY ACT FINDING: The Pianning Director or his authorized representative has determined that the proposal for waivers to construct two freestanding pole signs an a irregularly-shaped 9.1 acre property tocated north and east of the northeast comer of La Palma Avenue and Imperial Highway, having frontages of 549 feet on the north side of La Palma Avenue and 372 feet on the east side of Imperiai Highway (5711 - 5799 East La Palma Avenue - Canyon Village Plaza) falis within the definition of Categorical Exemptions, Class 11, as defined in the Sta!e EIR Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, TNEREFORE, BE IT RESOLVED thattheAnaheim City Planning Commission does hereby deny subject Petition for Variance on the basis of the aforementior.ed findings.
