WHEREAS, the City ~'lanning Commission did hold a pubtic hearing at the C:i~~ic Center in the Citiy of Anaheim on Se~temher 29, 1997 at 1:30 p.m., notice of said public hearing having been duly ~iven as required by law and in accordance with the provisions of the Anaheim MuniciFal Code, Chapter 18.03, to hear and consider evidence for and against said pr~posed conditicnal use permit and to investigate and make findings and recommendations in connect;on therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in iu behalf, and after due consideration of all evidence and reaorts offered at said hearing, does ~nd and determine the following facts: 1. That the proposed use is properly one for which a conditi~nal use permit is authorized by Anaheim Municipal Code Section 18.44.050.160 to retain an existing two-story, 23-anit motel. 2, 'That the proposed use is hereby denied. 3, That the size and shape of the site proposed for the use is not adequate to allow the full developmeni of the proposed use in a manner not detrimental ta the particular area nor to the peace, health, safety and general welfare of the Citizens of the City of Anaheim; , _~. That the pxoposed use ~vill adversely affect the adjoining land uses and tl~e ;_:o~vth and development of the area in ~vhich it is proposed to be located becai!se this motel operation has been exercised in a manner which has resulted in an ir~.,rdinate number of calls for service to this property, causing a disproportionate draw upon Police Department and Code Enforcement Division resources and causing secondar~ detrimental impact to the peace, health, safety and general welfare of the citizens of the City of Anaheim; and that the types of calls for Pclice Department and Code Enforcemcnt Divisio~i service continue to involve incidents detrimental to the public health, peace, safety and welfare; $, That the granting of the conditional use permit will be detrimental to the peac~:;; health, safety and general welfare of the citizens of the City of Anaheim because the c;;ntinuing and ongoing Code violations and criminal activity indicate the owner's inability to operate this business in compliance with City, County, and State regulations even afler revocation and/or modification proceedings for the previous conditional use permit by the Planning Commission. a Hearing Gfficer and the City Council; G. That two people spoke in favor of subject request and two people spoke in opposition to subject request at said public hearing; and that correspondence was recei~~r~_~ in opposition to the subject petition. CALIFO1tNIA ENV[RONMENTAL QUALITY ACT FINDiNG: The Planning Director or his authorized representative has determined that the proposed project falls within the definition of Categorical Exemptions, Class 21, as defined in the State EIR Guidelines and is, therefore, categorically exempt from the requirement to prepar~ an EIR. NOW, THEREEORE, BE IT RESOLVED that tt~e Araheim City Planning Commission does hereby deny subject Petition for Conditional Use 1':s7~it, on the basis of the aforementioned findings.
