PC97-144 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING CERTAIN CONDITIONS OF APPROVAL OF RESOLUTIO ONDI,TTON PUSE PE M T NO. 3924~ON ~N(TH WHEREAS, on May 20,1997 the City Council adopted Resolution No. 97R-71 to approve Conditional Use Permit No. 3924 to construct a gymnasium/auditorium and classroom for a private educational facility (Fairmont Priva.!e School) with waivers ~f minimum parking lot landscaping, minimum number of parking spaces, maximum structural height, and minimum landscaping adjacent to residential zones; and WHEREAS, said Resolution No. 97R-71 includes the following condition of approval: g, lfiat no roof-mounted air conditianing units or other mechanical equipment shall be permit±ed. Any ground-mounted air conditioning units or mechanical equipment shall be located on the east side of the building (away from nearby residences and residential zoning). WHEREAS, subject property is currently vacant and is zoned CL (Commercial, Limited) and that the property is located in the Brookhurst Commercial Corridor Redevelopment Project Area. WHEREAS, the petitioner has submitted a request, including plans, to permit two air conditioner units to be placed on the ruof of the gymnasium/auditorium building; and WHEREAS, the submitted plans, fabeled Exhibit Nos. 4 and 5, show :he two air conditioning units would be located at the west portion of the roof, set back about (~l , ~ and _l~ feet from the w'est, north and south property lines); and that the proposed units ~vould be 3 feet high on a sloping roof surrounded by a 3 foot high parapet; and that ~ve ventilation fans would be located on alternating sides of the ridge line in the center of the roaf ; and WHEREAS, line-of-sight drawings show the proposed air conditioning units would not be visible from any adjacent properties because of screening by the parapet ~vall and the trees proposed on-site. _i_ PC97-144 CR3Q78PL.WP ~ ~ WHEREAS, the City Planning Commission did hold a public hearing at xhe Civic Cen~er in the City of Anaheim on October 13, 1997, at 1:3~0 g.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said pruposed amendment and to investigate and make £'inding~ and': recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and repons offered at said hearing, does ~nd and determine the following fac4s: 1. That the proposed modification is reasonable necessary to permit reasona~ile : operation under the conditional use permit, as ariginally granted; and 2, That no one indicated eae~n oresos uon to lt~i~e snbj ct p t~ion. PPosition; and t h a t n o c o r r e s p o n d e n c e w a s r e c e p p ,~,ALiFORNiA CNVIRONMENTAL QUALITY AGT FINDII~i~: That the Anaheim City Planning Commission has reviewed the proposal to amend or delete a condition of approval g~rtaining to prohibited roof-mounted equipment in connection with an approved gymnasium/auditorium and classroom for a private educational facility and does hereby find that the Negative Declaration previously approved in connection with conditional use permit is adequate to serve as the required environmental documentation in connection with this request upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the previously approved Negative Declaration -ogether with any comr,ients received during the public review process and further ~nding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW THEREFORE BE IT RESOLVED that Condition No. 8 of Resolution No. 97R-71, adopted in connection with Cnnditional Use Permit No. 3924, is hereby amended to read: 8, That roof mounted mechanical equipment, as shown on Exhibit Nos. 4 and 5, shall be limited to a maximum of two (2) roof-mounted air conditioner units and ~ve (5) ventilation fans, not to exceed three (3) feet in height, painted to match the building and roof, and screened by a three (3) foot high parapet ~~all surrounding the entire roofline.
